State v. Mr. S (DMC No. 4813)

NOT CHARGED | SEXUAL ABUSE – State v. Mr. S. (DMC No. 4813) (Gilbert PD  Investigated): Mr. S. was a substitute nurse at a local grade school, when a 3rd grade girl claimed to have been touched on the breast by him.  Detectives contacted Mr. S. and we became involved.  Mr. S. passed a polygraph, and then we accompanied him to the Detectives to give a statement and to take a Computerized Voice Stress test.  Detectives claim that he passed when asked if he accidently touched her breast.  Detectives still forward the information to the Maricopa County Attorney’s Office, and we were successful in convincing them to “turn down” the case for prosecution.  No charges were ever brought against Mr. S.

State v. Mr. M (DMC No. 6737)

NOT CHARGED | SEXUAL ABUSE – State v. Mr. M. (DMC No. 6737) (Oro Valley PD & Bakersfield PD Investigated): Mr. M. had befriended a young woman who had a 14 year old daughter.  They had all gone down to Nogales, Arizona on vacation.  The girl’s mother began attempting to extort money out of Mr. M., and then claimed that she would tell police that he had touched her daughter. Reports were made to the Bakersfield Police, who had interviewed Mr. M. (to which he denied all claims).  It was then referred to Oro Valley PD and we became involved.  We were able to shut down the investigation with Oro Valley PD, and also CPS.  No charges were ever brought against Mr. M.

State v. Mr. A. (DMC No. 10474)

REDUCED (All) | 7 COUNTS OF SEXUAL CONDUCT WITH A MINOR (DCAC)/3 COUNTS OF SEXUAL ASSAULT/3 COUNTS OF SEXUAL ABUSE ALL REDUCED to “attempted sexual conduct/child abuse” with probation and zero days in jail – State v. Mr. A. (DMC No. 10474) (Apache County Superior Court CR2011-076): Mr. A. was accused of having sex with two different girls that were 14 years old when he was 17 years old. Even though Mr. A. was a minor, the fact that this case was a dangerous crimes against children (DCAC) because the victims were 14 or younger, caused him to be charged as an adult.  He was facing a minimum of 65 years in prison on the sexual conduct with minor charges alone.  We were able to present mitigating evidence, which included a Psychosexual Evaluation showing Mr. R. not to be a risk, and we secured an offer to probation with no further jail.  Although he had been in jail pending the disposition of the case, we were able to resolve the case in a fairly timely manner and he is currently doing very well on probation as a free man.

State v. Mr. A (DMC No. 10210)

NOT CHARGED | SEX ABUSE– State v. Mr. A. (DMC No. 10210) (Mesa PD Investigated): Mr. A. was a Doctor who was conducting a standard exam, when a 50 year old patient with mental issues accused him of fondling her breasts while using a stethoscope.  Because Mr. A. had been previously accused of similar conduct in another State, and had a prior civil case filed against him almost 30 years earlier, Detectives began to investigate.  We became involved with Detectives and the Medical Board, and showed that we hired a Private Investigator who had performed research on the alleged victim.  She had made similar allegations regarding others in the past, and had mental issues.  When she was confronted with this by Detectives, she no longer wished to seek prosecution.  No charges were ever brought against Mr. A. and his medical license was not affected.

State v. Mr. R (DMC No. 10230)

NOT CHARGED | 4 COUNTS OF CHILD MOLESTATION (DCAC)/4 COUNTS OF SEXUAL ABUSE  | State v. Mr. R.  (DMC No. 10230) (Chandler PD Investigated): Mr. R. was married to his wife for 6 years when the 14 year old step-daughter accused him of ongoing sexual conduct.  A “confrontation call” was conducted between the alleged victim and Mr. R. (which was tape-recorded by police) in which he denied everything.  He was subsequently arrested and brought into the station where he invoked his right to counsel.  We then brought Mr. R. back to the station where we allowed him to be interviewed by Detectives with us present.  We also submitted copies of the ongoing divorce paperwork which had since been filed, which contained inconsistencies in the alleged victim’s story.  Although the Detectives routed the case to the County Attorney’s Office, we were able to convince the prosecutor not to file charges.  Mr. R. was originally facing a minimum of 40 years in prison if he was to be convicted.

State v. Mr. G (DMC No. 7687)

Mr. G was a family friend with a lady who lived in the valley, and he ended up taking her daughter and son over to his house to spend the night. He was then accused of touching the 17 year old daughter’s breasts while giving her a back rub, and penetrating her vagina with his fingers. She alleged that she felt she could not leave his house. Mr. G. was ultimately charged with Felony Sexual Assault under Arizona Revised Statute ARS 13-1406, Felony Sexual Abuse under Arizona Revised Statute ARS 13-1404 and Felony Kidnapping under Arizona Revised Statute ARS 13-1304.

The Police also claimed that they conducted a “confrontation call” in which the alleged victim confronted him on the telephone and he admitted to these acts. However, he stated he thought that his behavior was consensual and that the alleged victim was always free to leave at any time. At Trial, we presented all of this evidence, along with an extensive history of the alleged victim lying to her family and others regarding numerous other situations. The Jury found that she was not credible and returned a verdict of Not Guilty regarding all charges (Sex Assault, Sex Abuse, and Kidnapping). Mr. G was originally facing well over a decade in Prison if he was to be convicted.

State vs. Mr. T (DMC No. 9769)

NOT CHARGED | CHILD MOLESTATION/ SEX ABUSE – (DMC No. 9769) (Gilbert Police Department): Mr. T. was accused by his half sister of molesting her when she was a child. She also claimed that recently (when she was 16 years of age) Mr. T. had snuck into her room while she was asleep. She claimed that he put a blanket over her head and fondled her and took pictures while she pretended to be asleep. Due to questions regarding Mr. T.’s half sisters motivation for making the report, and the fact that her other sister was in the room at the time and reported neither seeing nor hearing anything, we were able to convince detectives and prosecutor’s not to file charges.
