Board Certified Criminal Law Specialization

As of the start of 2021, the State Bar of Arizona Board of Legal Specialization listed only 68 Criminal Law Specialists in the entire state.  Of these 68, only 46 are located in Maricopa County and are allowed to handle private cases.  DM Cantor has 3 Criminal Law Specialists, the most of any firm in Arizona.  When defending DUI allegations, it is critical to have as many Specialists on your legal team as is possible.

The specialization process is so rigorous that only 34 current Criminal Law Specialists were certified in the last 21 years.  In addition, all specialists must be approved for re-certification every 5 years.  At DM Cantor, our Specialists have conducted Jury Trials on countless DUI and Vehicular crime cases.

Every case defended by DM Cantor includes at least 1 Board Certified Criminal Law Specialist on the legal team who is directly handling or supervising the case’s progress.

We wouldn’t have it any other way.

DUI Defense in Scottsdale: Preparing a Successful Defense

The goal of an experienced Scottsdale DUI legal team is to build the best possible defense. Facts must be analyzed to form a working strategy with an effective defense, such as one of the following:

  • Denial of Right to Counsel – If you request a lawyer after being detained for DUI in Scottsdale, the police officer must provide you with a phone as soon as reasonably possible. Cases can be dismissed if this request is ignored.
  • No Probable Cause for Arrest – If an officer does not have probable cause for an arrest, charges can be dismissed. The National Transportation Safety Board (NTSB) has set standards for field sobriety tests. If this test is incorrectly administered, the charges may qualify for dismissal under “no probable cause for arrest.”
  • No Actual Physical Control of the Vehicle – Scottsdale summers can be hot and simply sitting in a car requires the engine running to turn the air conditioning on. If you decide to sleep off alcohol in your running vehicle in a parking lot, you are not in physical control of the vehicle.
  • Inaccuracy of Blood or Breath Testing Equipment – Arizona Department of Health Services (DHS) has established rules for the maintenance of breath testing devices; we will check those records to see if there are any abnormalities. If the device is out of calibration between set testing dates, the breath test results would be inadmissible in court.
  • No Reasonable Suspicion to Stop – Scottsdale police cannot stop you based on sex, religion, gender, age or any other possible discriminatory basis. Such a stop can be challenged in court.

Example of a Real Client DUI dismissed in Scottsdale:

(Scottsdale Municipal Court No. 9811790CR): Ms. D. was involved in a multiple car accident and was subsequently arrested for Extreme DUI. She submitted a .190 breath sample. Our aggressive DUI defense team was able to show that the calibration records for the Intoxilyzer machine were insufficient and the breath test results were suppressed. The Scottsdale City Prosecutor’s Office subsequently dismissed all charges.
