DISMISSED | DUI (DMC No. 9830) (Scottsdale City Court No. TR2010-38003): Mr. T. was stopped by Scottsdale police for having a headlight out. At first the officer could not smell alcohol, and then he found that he detected a faint odor. Ms. T. denied drinking, and then the officer gave her an eye test showing 2 cues of horizontal gaze nystagmus. She was subsequently arrested and blood was drawn. Her blood eventually came back below the .08 legal limit and we were able to have the prosecutor drop all charges.
