State v. Mr. H (DMC No.7177)

DISMISSED – Assault, State v. Mr. H. (DMC No.7177) (Tempe Municipal Court No. 07-976814): Mr. H. and his roommate were at a non-alcoholic fraternity event on ASU’s campus. When they returned to their dorm room, Mr. H.’s roommate struck him in the back with a beanbag. Mr. H. instinctively turned and punched his roommate in the face. He was subsequently charged with Assault. We were able to show the prosecutor that self-defense was proper. The State agreed with us and dismissed all charges.

State V. Mr. L. (DMC No. 9876)

DISMISSED | DUI (PRESCRIPTION DRUGS) (DMC No. 9876) (Tempe City Court No. 10-101855-2): Mr. L. was stopped for an improper right hand turn; subsequently a DUI investigation was pursued. Because Mr. L. was taking prescription drugs, a Drug Recognition Evaluation (DRE) was conducted and the officer stated that Mr. L. was under the influence of prescription drugs. We were able to have the DRE results precluded due to lack of chemical verification on Mr. L.’s blood. All charges were dismissed.

State v. Mr. W (DMC No.)

(Tempe Municipal Court No. 06-961209-2CR): Mr. W. made a left hand turn at 8th Street and Rural Rd. against the signs which stated, “No left turn.” He was subsequently stopped and admitted to drinking at Four Peaks Brewery. After he was arrested, he provided a .155 breath test to the police. We were able to contact the Tempe City Engineer’s Office and show that these particular left-hand turn signs were not in the proper area and were not completely visible to traffic. We convinced the prosecutor to dismiss the DUI’s in exchange for an Endangerment plea.

State v. Mr. H. (DMC No. 4687)

DUI (.133 BAC) REDUCED to SPEEDING/WEAVING TICKET due to ACTUAL PHYSICAL CONTROL ISSUE – State v. Mr. H. (DMC No. 4687) (Tempe City Court 04-725857): Mr. H. was observed in the City of Tempe sitting in his car parked in an alley way while he was sleeping and the engine was running. Officers woke him up and arrested him for DUI. He eventually provided a .133 BAC. We argued he was not in “Actual Physical Control” of his vehicle, and the State relented and offered a plea to a mere “speeding” and “weaving” ticket (what is known as “points”), in exchange for getting rid of the DUI charge.

State v. Ms. K (DMC No. 10698)

CONVICTION SET ASIDE | RECKLESS DRIVING – State v. Ms. K. (DMC No. 10698) (Tempe City Court 2011-028905): Ms. K. had been cited for a DUI which was reduced to a reckless driving.   She subsequently completed all classes and probation, and wished to go on to New Jersey in order to teach.  We were able to have the court set aside her judgment of guilt, and the complaints against her were dismissed in full.

State v. Mr. F (DMC No. 4996)

DISMISSED | OBSTRUCTING PUBLIC THOROUGHFARE DISMISSED – State v. Mr. F. (DMC No. 4996) (Tempe City Court 04-765642): Mr. F. was in downtown Tempe on Mill Avenue, when he ran across a street before the crosswalk signaled him to.  Traffic had to stop, and a bike patrol officer rode up and cited Mr. F. for “obstructing a public thoroughfare”.  Due to the age of Mr. F., and his clean criminal history, the prosecutor agreed to dismiss the charge in exchange for community service.

State v. Mr. H. (DMC No. 6618)

DISMISSED | DRIVING WHILE LICENSE SUSPENDED – State v. Mr. H. (DMC No. 6618) (Tempe City Court 06-935452): Mr. H. was stopped for exiting a driveway without his headlights on.  Once he was stopped, the officer asked Mr. H. if he knew his license was suspended.  Mr. H. said that he did know it was suspended.  After the officer ran a check, he also found that Mr. H. had two other warrants for his arrest for previous driving on a suspended license charges.  Due to witness issues just prior to Bench Trial, the State moved to dismiss all charges.

State v. Ms. H. (DMC No. 4808)

DISMISSED | DUI DRUGS (Ambien, Effexor) – State v. Ms. H. (DMC No. 4808) (Tempe City Court 04-720515-2): Ms. H. was accused of stopping approximately 5 feet into a crosswalk.  The officer gave her an eye test which he stated she “failed”.  She refused all other field tests and asked to talk to her father who was a lawyer.  Because the officer did not allow her to talk to her father, and the fact that she was on prescription medications for Ambien and Effexor, we were able to convince the prosecutor to dismiss all charges.

State v. Mr. H. (DMC No. 6633)

REDUCED | UNDERAGE DRINKING (.056 BAC) and DRIVING REDUCED to minor in possession of alcohol with zero days jail – State v. Mr. H. (DMC No. 6633) (Tempe City Court 06-946991): Mr. H. was pulled over for allegedly running a red light. Upon contact, the officer detected alcohol and gave Mr. H. a handheld breath test, which revealed a .056 BAC.  Because Mr. H. was under 21, he was subsequently cited for underage drinking and driving (underage DUI).  Although he was facing the revocation of his license until age 21, we convinced the prosecutor to reduce it to a minor in possession of alcohol charge with zero days in jail.  No license suspension or DUI type conviction was left on Mr. H.’s record.

State v. Mr. L. (DMC No. 8429)

Mr. L. was a student at Arizona State University who was with his roommate inside of the Big Bang Bar. When his roommate was confronted by the Manager, he was found to have a fake ID. Police were then called and Mr. L admitted that he gave his ID to his roommate so he could get into the bar. He was then cited with Unlawful Use of a Driver’s License under Arizona Revised Statute ARS 28-3478(2). We were able to convince the Prosecutor to dismiss the charge in exchange for Mr. L completing several alcohol awareness classes.
