State v. Mr. F (DMC No. 6495)

Mr. F was driving his father’s car, when he was issues a photo radar ticket in the City of Tempe. We went into the hearing and presented a color copy of Mr. F’s father’s license. Because the gentleman in the license (who owned the car) appeared much older than Mr. F, the Prosecutor was required to present somebody who could testify as to the identity of the person in the photo radar ticket. The Prosecutor was unable to proceed, and they dismissed the Speeding ticket written under Arizona Revised Statute ARS 28-701(A).

State v. Mr. S (DMC No. 7941)

Mr. S was seen driving 55 in a 45 mile per hour zone near Kyrene Road and Guadalupe Road in Tempe, Arizona. He was pulled over and it was discovered that the license plate on his car belonged to a Toyota pickup truck which Mr. S owned. Mr. S admitted that he had bought the vehicle the day before from a guy who lived in Pennsylvania. He said it did not pass emissions, so he put his other license plate (from a second car he owned) on the vehicle. We were able to show the Prosecutor that there is a rule which allows 3 day grace period for driving a vehicle between the purchase date and registration date in order to allow it to be taken to emissions. The Prosecutor agreed, and dismissed the charge of Fictitious License Plate under Arizona Revised Statute ARS 28-2531(B)(1).

State v. Ms. S. (DMC No.)

(Tempe Municipal Court No. 03627814CR): Ms. S. was stopped by City of Tempe Police after an accident. They placed her under arrest for having an odor of alcohol. We were able to show that the low amount of alcohol in her system had no effect on her driving, and was not a factor in the accident. All charges were then dismissed by the prosecutor.

State. vs. Mr. W. (DMC No. 9873)

REDUCED | EXTREME DUI (.168 BAC) State. vs. Mr. W. (DMC No. 9873) (Tempe City Court No. 10-046457): Mr. W. was leaving Hungry Howie’s Pizza in Tempe when he was trying to get into his apartment development. A tow truck was blocking the entrance and Mr. W. thought he could squeeze by. He did not see that the tow truck’s boom was down, and he struck it. Mr. W. then called the police. Ultimately police arrived and detected an odor of alcohol and arrested Mr. W. While at the station, he provided a .147 breath test, followed by a .168 breath test and then a .170 breath test. Because of the irregularities in the breath testing device, coupled with the fact that Mr. W. was the one that called the police, we were able to negotiate a plea from an Extreme DUI with 30 days in jail down to a regular misdemeanor DUI with 1 day in jail.

State. vs. Mr. T. (DMC No. 9864)

REDUCED | EXTREME DUI (.164 BAC) State. vs. Mr. T. (DMC No. 9864) ( Tempe City Court No. 10-070826): Mr. T. was seen driving on University Drive in Tempe. The officer claimed that he was repeatedly weaving back and forth in the center lane. The officer then claimed Mr. T. drove 5 blocks before he pulled over. He eventually provided a .164 breath alcohol reading. We discussed with the prosecutor that the stop was somewhat questionable as it did not appear that Mr. T. ever left his lane markers. Before we filed a motion based on No Reasonable Suspicion to Stop, the prosecutor extended an offer to a first offense DUI with 1 day in jail and dismissed the Extreme DUI which would have required 30 days in jail.

State v. Mr. N. (DMC No. 7230)

REDUCED | EXTREME DUI (.177 BAC) – State v. Mr. N. (DMC No. 7230) (Tempe City Court No. 07-981603): REDUCED to Regular DUI Police were called because it was alleged that Mr. N drove his vehicle towards a girl’s vehicle. Her fiancé then became upset and the 2 exchanged words. Even though Mr. N stated that he was merely “kidding around”, the 2 men got into a fight. Once police arrived, they arrested Mr. N and took him to the station where he provided a .177 Breath Alcohol Content. (Tempe Municipal Court No. 06-963577-3CR): The officer claims Mr. S. made numerous wide right turns before stopping in a Taco Bell parking lot. The officer claimed he detected an odor of alcohol and that Mr. S. admitted to drinking a few beers. After he was arrested, he provided a breath test of a .164. Due to the possible issues regarding no reasonable suspicion to stop, we were able to secure a dismissal of the Extreme DUI with an offer to a regular DUI and 2 days in jail instead of 30 days.
