U.S. v. Mr. R (DMC No. 4799)

REDUCED | SEX ABUSE REDUCED to MISDEMEANOR with ZERO DAYS JAIL – U.S. v. Mr. R. (DMC No. 4799) (Maricopa County Juvenile Court JV537449): Ms. R. was a 14 year old junior high student who was with some other boys when he grabbed another student’s breast.  The police were called and he was charged with felony sex abuse.  We were able to keep the case in Juvenile Court, and have it reduced to a simple misdemeanor with probation and no jail.  There is no adult conviction on Mr. R.’s record.

State v. Mr. M (DMC No. 10749)

REDUCED | VOYEURISM / SEX ABUSE REDUCED to “surreptitious photographing” with probation and 90 days jail – State v. Mr. M. (DMC No. 10749) (Pinal County Superior Court CR2011-02322): Mr. M. was accused of going into a Walgreens drug store and placing his cell phone camera underneath a young lady’s skirt.  He was also accused of intentionally rubbing his elbow across her breast when he walked by. He was confronted by the young lady’s grandmother, and store employee’s arrested him.  Due to the fact that he was on probation for prior felony offenses, and due to allegations that he had done this in the same store previously, the prosecution originally wanted prison time.  We were able to present mitigating evidence and get the case reduced down to a simple “surreptitious photographing” with probation and 90 days of jail. Originally Mr. M. was facing well over 5 year in prison.

State v. Mr. F (DMC No. 4737)

REDUCED | SURREPTITIOUS PHOTOGRAPHING REDUCED to “attempt” with probation and zero jail – State v. Mr. F. (DMC No. 4737) (Maricopa County Superior Court CR2004-010581): Mr. F. was at home one day when he heard the neighbors dog barking frantically.  When he looked over the wall, the 18 year old neighbor came outside with no clothes on.  He discovered she would often engage in this behavior, and he took several photographs of her over the next 6 months with his camera over the wall.  When he dropped the roll of film off at the local drug store, they notified police.  He openly told police he didn’t realize it was illegal because he thought she was in public view.  It was explained that because he had to peer over the wall (i.e., above eye level), it was illegal.  Although the neighbor was highly upset, we were able to secure a plea to a simple “attempt” with probation and zero days of jail. Mr. F. was not required to register as a sex offender.

State v. Mr. & Mrs. E (DMC No. 10680)

NOT CHARGED | FAILURE TO REPORT CHILD SEXUAL ABUSE NOT CHARGED – State v. Mr. & Mrs. E. (DMC No. 10680) (Maricopa County Sherriff’s Office investigated): Mr. & Mrs. E. were told by their daughter that the neighbor’s son (a 22 year old with a mind of a 13 year old) had touched her.  Other allegations came from other kids in the neighborhood.  As the Sherriff’s Office began investigating, it became apparent that they were also investigating Mr. & Mrs. E. for failure to report a child sexual abuse.  We became involved, and helped facilitate not only the prosecution of the neighbor kid, but also we made sure no charges were ever brought against Mr. & Mrs. E.

State v. Mr. K (DMC No. 10225)

REDUCED | SEX OFFENDER LEVEL REDUCED – State v. Mr. K. (DMC No. 10225) (Phoenix Police Department modified): Mr. K. had previously been convicted of a felony charge of sex conduct with a minor in the State of California.  As part of his sentence, Mr. K. was required to register as a sex offender.  Upon moving to Arizona he was evaluated and considered to be a “level 2” sex offender.  We were able to work with the Phoenix Police Department, providing them documentation that supported a lower level of registration, and we received a reduction of Mr. K.’s sex offender classification down to a level 1.  As a result of this reclassification, Mr. K. is not subjected to having his name and photographed being displayed on the DPS sex offender website.

State v. Mr. S (DMC No. 6747)

NOT CHARGED | SEXUAL ABUSE/CHILD ABUSE  – State v. Mr. S. (DMC No. 6747) (Mesa PD & CPS Investigated) : Mr. S. had custody of his two grade school children due to his ex-wife being a drug addict and abandoning them.  While at the school nurses office, the older sister stated that Mr. S. had struck the younger child with a belt.  In addition, she claimed that he once touched her breasts.  CPS and Mesa PD became involved, and they took photos and questioned Mr. S.  We became involved on the case, and we’re able to show that the son was ADHD and Mr. S. had not abused the child when he disciplined him for bad behavior.  In addition, we showed that the contact with the older daughter was not of a sexual nature.  No charges were ever brought against Mr. S.

State v. Mr. S (DMC No. 4813)

NOT CHARGED | SEXUAL ABUSE – State v. Mr. S. (DMC No. 4813) (Gilbert PD  Investigated): Mr. S. was a substitute nurse at a local grade school, when a 3rd grade girl claimed to have been touched on the breast by him.  Detectives contacted Mr. S. and we became involved.  Mr. S. passed a polygraph, and then we accompanied him to the Detectives to give a statement and to take a Computerized Voice Stress test.  Detectives claim that he passed when asked if he accidently touched her breast.  Detectives still forward the information to the Maricopa County Attorney’s Office, and we were successful in convincing them to “turn down” the case for prosecution.  No charges were ever brought against Mr. S.

State v. Mr. M (DMC No. 6737)

NOT CHARGED | SEXUAL ABUSE – State v. Mr. M. (DMC No. 6737) (Oro Valley PD & Bakersfield PD Investigated): Mr. M. had befriended a young woman who had a 14 year old daughter.  They had all gone down to Nogales, Arizona on vacation.  The girl’s mother began attempting to extort money out of Mr. M., and then claimed that she would tell police that he had touched her daughter. Reports were made to the Bakersfield Police, who had interviewed Mr. M. (to which he denied all claims).  It was then referred to Oro Valley PD and we became involved.  We were able to shut down the investigation with Oro Valley PD, and also CPS.  No charges were ever brought against Mr. M.

State v. Mr. B. (DMC No. 10432)

NOT CHARGED | SOLICITATION OF PROSTITUTION – State v. Mr. B. (DMC No. 10432) (Chandler PD Investigated): Mr. B. went to Massage Envy, and was waiting to get a massage when a masseuse came in.  He made a joke about being touched in his “intimate areas” and the masseuse became offended.  He was asked to leave, and he asked for a refund and told them he was just kidding.  We became involved and convinced Chandler PD that it wasn’t even worthy of taking a report.  In addition, we helped Mr. B. cancel his contract with Massage Envy and he received a full refund for all prepaid massages.  Mr. B. was never charged, nor does he have any type of record.

State v. Mr. G (DMC No. 4954)

NOT CHARGED | PUBLIC SEXUAL INDECENCY – State v. Mr. G.  (DMC No. 4954 ) (Phoenix PD Investigated): Mr. G. was accused of pulling up alongside another vehicle at night with his pants down while masturbating.  The alleged victim stated that he then swerved towards her and they almost collided.  She got his license plate number and called police.  Her passenger at the time was her grade school son.  When police contacted Mr. G., he invoked his right to an attorney.  A photographic lineup was held and neither of the alleged victims picked Mr. G.  Due to our contact with the Detective, we would not allow them to take a current photograph of Mr. G., nor would we allow them to interrogate him any further.  No charges were brought against Mr. G.
