State v. Mr. L. (DMC No. 4994)

REDUCED | DUI (.067 BAC) REDUCED to SPEEDING TICKET – State v. Mr. L. (DMC No. 4994) (Florence Justice Court TR2004-0590): Mr. L. was travelling east bound on Price Road approximately a quarter mile east of State Route 79 in Florence, Arizona when he was pulled over for travelling 35 in a 15 mph zone.  The DPS Officer detected an odor of alcohol and arrested Mr. L. for DUI.  At the police station, Mr. L. provided a .067 BAC breath test.  Although the Prosecutor originally wanted Mr. L. to take a Reckless Driving conviction, we convinced him to dismiss the DUI in exchange for a simple Speeding ticket and a small fine.

State v. Ms. D (DMC No. 4742)

DUI (.076 BAC)/UNDERAGE DRINK and DRIVE REDUCED to MINOR in CONSUMPTION – State v. Ms. D. (DMC No. 4742) (Florence Justice Court TR2004-0370): Ms. D. was pulled over by DPS Officers on State Route 79 at Mile Post 136 in Florence, Arizona for allegedly swerving over the “fog line”.  Upon contact, she admitted she was 19 years old and had consumed alcohol earlier in the day.  After a DUI investigation ensued, she was taken to the station and given a breath test which resulted in a .076 BAC.  Because of the questionable nature of the stop, we were able to convince the Prosecutor to dismiss the DUI and Underage Drink and Drive in exchange for a simple Minor in Consumption ticket.  Originally, Ms. D. was facing a 2 year license suspension and jail time.
