DUI (.076 BAC)/UNDERAGE DRINK and DRIVE REDUCED to MINOR in CONSUMPTION – State v. Ms. D. (DMC No. 4742) (Florence Justice Court TR2004-0370): Ms. D. was pulled over by DPS Officers on State Route 79 at Mile Post 136 in Florence, Arizona for allegedly swerving over the “fog line”.  Upon contact, she admitted she was 19 years old and had consumed alcohol earlier in the day.  After a DUI investigation ensued, she was taken to the station and given a breath test which resulted in a .076 BAC.  Because of the questionable nature of the stop, we were able to convince the Prosecutor to dismiss the DUI and Underage Drink and Drive in exchange for a simple Minor in Consumption ticket.  Originally, Ms. D. was facing a 2 year license suspension and jail time.
