State v. Mr. H (DMC No. 5517)

NOT GUILTY/COMPLETE ACQUITTAL at BENCH TRIAL | HIT and RUN – State v. Mr. H. (DMC No. 5517) (Mesa City Court 2005-016635): Mr. H. was accused of a hit and run for backing out of a parking space and striking another vehicle.  A witness said the Mr. H. looked outside of his car, then got back in and drove away.  When Mr. H. was contacted, he claimed that he didn’t realize he had hit another vehicle.  At trial, we were able to convince the Judge that the collision was so minor, and that Mr. H. was looking in the wrong spot, that the State could not meet its burden of proof.  Mr. H. was found not guilty of all charges.

State v. Mr. O (DMC No. 4432)

ENDANGERMENT to RECKLESS DRIVING with ZERO DAYS in JAIL – State v. Mr. O. (DMC No. 4432) (Mesa City Court 2003-071445): Mr. O. was involved in divorce with a child custody battle, when he went to his residence to remove some property.  An officer was assigned to do a “civil standby”, and as Mr. O. was leaving,  it was alleged that he swerved at two neighbors that were standing on the sidewalk.  They both jumped back, and then Mr. O. was accused of driving within 12 inches of a patrol car.  We were able to show the Prosecutor that both of the neighbors, and the police officer who conducted the civil standby were friends with Mr. O.’s wife and new boyfriend.  The Prosecutor agreed to reduce the endangerment down to a mere misdemeanor “reckless driving” with zero day’s jail.

State v. Mr. V (DMC No. 5221)

ENDANGERMENT REDUCED to a MISDEMEANOR DUI with TIME SERVED – State v. Mr. V. (DMC No. 5221) (Maricopa County Superior Court CR2002-000730): Mr. V. was charged with being involved in a DUI accident with injuries to a child.  He produced a .183 BAC, and he was arrested for both DUI and felony endangerment.  Through our investigation, we showed that the child was playing with his skateboard and he ran out into the street directly in front of Mr. V.’s car in order to grab the board which had gotten away from him.  We convinced the Prosecutor to dismiss the felony endangerment in exchange for the misdemeanor DUI with a credit for 16 days of jail time which had already been served.  Mr. V. was facing up to 3 years in prison if he were to have been convicted.

State v. Mr. G (DMC No. 5083)

REDUCED | VEHICULAR AGGRAVATED ASSAULT/FELONY CRIMINAL DAMAGE REDUCED to PROBATION with ZERO DAYS in JAIL – State v. Mr. G. (DMC No. 5083) (Maricopa County Juvenile Court JV-162395): Mr. G. had gotten into a vehicular altercation with a motorcycle (i.e. “road rage”), when Mr. G. took his vehicle and struck the motorcycle.  The motorcycle went down and was damaged, and then Mr. G. and the driver of the motorcycle became engaged in a physical fight.  Other drivers broke up the fight, and Mr. G. drove off.  We were able to have the case reduced to a misdemeanor criminal damage with probation and zero day’s jail.  Originally, Mr. G. was facing felony charges in adult court, which would have exposed him to 5 to 15 years in prison under the vehicular aggravated assault charge alone.

State v. Mr. P. (DMC No. 10319)

NOT CHARGED | EXTREME DUI (.198 BAC) – State v. Mr. P. (DMC No. 10319) (White Tank Justice Court/DPS DR2010-058204):  Mr. P. was pulled over by DPS Officer on Glendale Avenue & 116th Avenue.  He was accused of travelling 70 MPH in a 45 MPH zone.  He was ultimately stopped and given field sobriety tests.  His breath test revealed .198 blood alcohol, and he was booked into jail. Due to discovery issues, the case was delayed beyond the statute of limitations and no charges were brought.

State V. Mr. D (DMC No. 9909)

(DMC No. 9909) (Mesa City Court No. 2010-001867): Mr. D. was seen driving without his headlights on. He turned into a Circle K and was contacted by an officer. Subsequently a DUI investigation ensued and a blood test was conducted which revealed a .198 blood reading. Mr. D. had asked for an attorney, and was not allowed to contact one. An Evidentiary Hearing was set regarding denial of right to counsel, and the state dismissed all charges at that time. Mr. D. was originally facing over 30 days in jail.

State v. Ms. A. (DMC No.)

DISMISSED | EXTREME DUI (.195 BAC)(Maricopa County Superior Court No. 0211019CR): Ms. A. was allegedly involved in a car accident and DPS was called to the scene. When they arrived, she was not in her vehicle. She eventually provided a breath sample, which revealed a .195 BAC and she was arrested for Extreme DUI. We filed a Motion based on “Corpus Delecti” demonstrating that the State could not place Ms. A. behind the wheel, nor could they specify a time of driving. The Maricopa County Attorney’s Office then filed a Motion to Dismiss all charges.

State v. Mr. A. (DMC No.)

(Chandler Municipal Court No. 03-C-2181951CR): Mr. A. was involved in an alleged hit and run accident. He was subsequently arrested and provided a .195 blood BAC qualifying him for an Extreme DUI. Due to various identification problems with the case, we were able to convince the prosecutor to dismiss the DUI charge and simply plead Mr. A. to Leaving the Scene of an Accident with zero days in jail.

State v. Ms. D. (DMC No.)

DISMISSED | EXTREME DUI (.190)(Scottsdale Municipal Court No. 9811790CR): Ms. D. was involved in a multiple car accident and was subsequently arrested for Extreme DUI. She submitted a .190 breath sample. We were able to show that the calibration records for the Intoxilyzer machine were insufficient and the breath test results were suppressed. The Scottsdale City Prosecutor’s Office subsequently dismissed all charges.

State v. Mr. A. (DMC No.)

DISMISSED | EXTREME DUI (.189 BAC)(Phoenix Municipal Court No. 3493886CR): Mr. A. was seen by an officer traveling 95 to 100 miles per hour on the I-17. After he was stopped, a moderate odor of alcohol was observed. He was subsequently arrested and provided a .189 blood sample giving him an Extreme DUI. Before blood was obtained he requested to speak to a lawyer, and the officer did not accommodate that request. We filed a Motion to Dismiss based on a denial of right to counsel. The judge agreed with us and dismissed all charges.
