DISMISSED | SUPER EXTREME DUI (.200 BAC) DISMISSED – State v. Mr. W. (DMC No. 4774) (North Mesa Justice Court TR03-03368CR): Police arrived at State Route 87 and mile post 206 when they were called to the scene of a single car accident.  Mr. W.’s vehicle had struck a post and had gone off in an embankment.  Mr. W. was not behind of the wheel of the car when officers arrived.  He was subsequently arrested and provided a .200 blood alcohol concentration and was charged with SUPER EXTREME DUI.  We were able to preclude the primary officer into the case from testifying due to his violation of the discovery rules.  The case was dismissed.
