State v. Ms. E (DMC No. 6209)

PARTIAL ACQUITTAL at BENCH TRIAL | DRIVING WHILE LICENSE SUSPENDED – State v. Ms. E. (DMC No. 6209) (Phoenix City Court 3415491): Ms. E. was pulled over for allegedly having a fake registration tag on her license plate. Officer’s then told her that her license was also suspended. At trial, we admitted to the fictitious license plate sticker, but fought the Driving on Suspended License allegation due to the fact that even though the notice was mailed to Ms. E. regarding a suspension, it did not actually go into effect until 3 days after the actual incident. If Ms. E. had been convicted of the suspended license charge, she would have lost her license for a year.

State v. Ms. A (DMC No. 7560)

DISMISSED | ARSON/RECKLESS BURNING – State v. Ms. A. (DMC No. 7560) (Phoenix City Court 3684834): Ms. A. had been in an argument with her boyfriend at a BBQ, and when she left she set a box on fire in the driveway. When police found her parked on the street, they noticed smoke inside of her vehicle. They saw she had a burning pan of charcoal in the backseat, along with a container of lighter fluid.

She had told police that she had merely wanted to “get her boyfriend’s attention”. She was originally going to be charged with Arson, however we were able to convince the Prosecutor to charge it merely as a misdemeanor “Reckless Burning”. We then negotiated a “misdemeanor compromise”, and the State agreed to dismiss all charges. Ms. A. was originally facing a felony with potential prison time.

State v. Mr. T. (DMC No. 10137)

DRIVER’S LICENSE REINSTATED (DUI and multiple driving on suspended license violations) – State v. Mr. T. (DMC No. 10137) (Phoenix City Court 583025102/North Mesa Justice Court 0309071/Payson Justice Court TR-2002001278): Mr. T. was a local homeless man in Phoenix when he made national news when he found a backpack containing ($3,300). He turned the backpack in and the money went back to the college student who had lost his student loan money. He was featured in People magazine as a “Hero Among Us”, and was praised for his honesty. DM Cantor took on Mr. T.’s case Pro Bono (for free). We made sure all terms of his prior probation were satisfied and we reinstated his driving privileges. He now lives in an apartment and holds steady employment. He works as a landscape maintenance supervisor and works for free at the homeless shelter helping others.

State V. Ms. C. (DMC No. 9856)

DISMISSED | SUPER EXTREME DUI (.318 BAC) (DMC No. 9856) (Phoenix City Court No. 2010-9025304): Ms. C. was stopped for erratic driving and subsequently arrested for a DUI. When she did provide a blood test, it revealed a .318 blood reading. She had asked to be released to get an independent test of her blood, which did not occur. We filed a motion to have the entire case dismissed based on a denial of a right to an independent test. The state agreed and all charges were dismissed against Ms. C.

State v. Mr. R. (DMC No. 9947)

DISMISSED | SUPER EXTREME DUI (.240 BAC) DISMISSED – State v. Mr. R. (DMC No. 9947) (Phoenix City Court 4285580): Mr. R. was observed coming up to an intersection to make a right turn, he slowed for 3 to 4 seconds and signaled before making a right turn into the correct lane. The officer pulled him over claiming that his turn was improper. Mr. R. was subsequently arrested and provided a .240 blood sample and was charged with SUPER EXTREME DUI. We filed a Motion for “No Reasonable Suspicion to Stop” and an Evidentiary Hearing was held. The judge ruled that the stop was improper, and all evidence of the stop was suppressed. The State was forced to dismiss the case in its entirety.

State v. Mr. V (DMC No. 4525)

NOT GUILTY/COMPLETE ACQUITTAL at BENCH TRIAL | ASSAULT – State v. Mr. V. (DMC No. 4525) (Phoenix City Court 3016206): Mr. V. had a tumultuous relationship with his ex-wife. She had accused him of putting a gun to her head, and assaulting her in the past. She now stated that he grabbed her by the throat and punched her as he was dropping off the kids from visitation. We were able to show that she was making up allegations in order to secure child custody. At trial we showed that the physical evidence did not match with her allegations. The Judge found Mr. V. not guilty of all charges.

State v. Mr. M. (DMC No. 4917)

DISMISSED | THEFT – State v. Mr. M. (DMC No. 4917) (Phoenix City Court 3090983): Mr. M. was an employee at a local Target, who would occasionally sell gift cards. Sometimes people would leave the gift cards behind, and they would be picked up off the counter-top by passersby and used for purchases. Mr. M. was accused of taking the gift cards and using them himself. We were able to show that there was a proof issue of who the actual victims were, and the State was forced to dismiss all charges.

State v. Ms. P (DMC No. 5682)

DISMISSED | THEFT – State v. Ms. P. (DMC No. 5682) (Phoenix City Court 3171368): Ms. P. worked at a Marshall’s department store, when she was arrested by Loss Prevention Officer’s for allegedly “skimming” money from the till. She confessed to stealing $1,500 over a 4 month time span. This alleged confession was both written and on video tape. The State was unable to comply with our Discovery request to produce the video tapes and notes, and they were forced to dismiss the case in its entirety.

State v. Mr. M (DMC No. 4887)

DISMISSED | SHOPLIFTING – State v. Mr. M. (DMC No. 4887) (Phoenix City Court 3164538): Mr. M. was at a Home Depot, when he was accused of attempting to leave the store with a metal door valued at a $175. He was charged with shoplifting, and we were able to show the Prosecutor that he was diagnosed with Alzheimer’s approximately 3 years earlier. After going through the Prosecutor’s “Hardship Committee”, we were able to convince them to dismiss the shoplifting exchange for some classes under a “diversion” program.

State v. Mr. B (DMC No. 10186)

DISMISSED | TRESPASS/HARASSMENT – State v. Mr. B. (DMC No. 10186) (Phoenix City Court 4358013): Mr. B. went to his ex girlfriends house (she was also his ex employee) in order to speak with her. The relationship had ended tumultuous, and she filed a lawsuit against Mr. B. When police were called, she claimed that he had trespassed and had been harassing her. Although he was arrested and charged, we were able to convince the Prosecutor to dismiss the harassment charge and allow Mr. B. to attend counseling in exchange for a dismissal of the trespass also pursuant to diversion.
