REDUCED | UNLAWFUL FLIGHT REDUCED to endangerment/misdemeanor DUI with 1 day jail – State v. Mr. L. (DMC No. 4493) (Maricopa County Superior Court CR2004-039118): Mr. L. was pulled over for having a headlight out. When the officer asked Mr. L. to step out of the vehicle, he sped off quickly. He was subsequently stopped and found to have marijuana on his possession. He was processed for DUI, and his urine came back with THC (a marijuana metabolite). He was subsequently cited for FELONY FLIGHT, POSSESSION of MARIJUANA, and DUI. We were able to convince the prosecutor to reduce the felony flight to an endangerment “open”, and dismiss the POSSESSION of MARIJUANA charge. He was sentenced to 1 actual day of jail for the DUI, and probation on the felony flight. When completed probation, that charge became a misdemeanor, and he has no felony on his record.
