State v. Ms. T (DMC No. 4686)

REDUCED | ENDANGERMENT/RECKLESS DRIVING REDUCED to “failure to obey a police officer” – State v. Ms. T. (DMC No. 4686) (San Tan Justice Court CR03-01052MI): Ms. T. was driving to pick up her children from a school function as it was getting dark, when she came upon an accident scene in which officers had set up cones and were stopping traffic.  She drove between the cones in order to go straight, and the officer stopped her.  As he was talking to her at the side of her car, she said she had to pick her kids up because “they could be in danger” and she took off.  The officer was almost knocked to the ground, and she finally stopped.  He asked her numerous times to exit the vehicle and she kept refusing numerous commands.   She was eventually pepper sprayed and dragged out of the vehicle.  Due to the fact that she had various mental issues, we were able to convince the prosecutor to dismiss the “endangerment” and “reckless driving” charges (which would have cost Ms. T. her driver’s license) in exchange for a “failure to obey a police officer” ticket with a fine only.

State v. Mr. G (DMC No. 4584)

REDUCED | RECKLESS DRIVING/AGGRESSIVE DRIVING REDUCED to “speeding” and “weaving” tickets – State v. Mr. G. (DMC No. 4584) (West Mesa Justice Court TR04-04312 CR): Mr. G. was on the 101 north bound near Chaparral Road when he began “road raging” with another truck.  He was tail gating the truck, and then he shifted lanes so quickly he came directly behind the officers unmarked police car.  He then snapped back in front of the truck, and flipped him off after he hit his brakes.  He then took off at 79 MPH and the officer pulled him over.  Mr. G. admitted he had lost his cool with the other driver.  Because Mr. G. was so young, we were able to convince the prosecutor to dismiss the “reckless driving” and “aggressive driving” charges (which carried potential jail time and would have cost Mr. G. his license) down to a “speeding” and “weaving” ticket with a fine and traffic school only.

State v. Mr. B (DMC No. 6574)

DISMISSED | RECKLESS DRIVING DISMISSED with diversion – State v. Mr. B. (DMC No. 6574) (Maricopa County Juvenile Court JV-1034027): Mesa Officers were called to an accident scene were they observed Mr. B.’s vehicle tipped on its side with several trees knocked down.  A witness claimed that Mr. B. passed him at 60 to 65 MPH at just past midnight.  Although the trees cost $1,500 to replace, we convinced the prosecutor to dismiss the “reckless driving” charge in exchange for diversion classes based on Mr. B.’s young age.

State v. Mr. W. (DMC No. 6593)

REDUCED | RECKLESS DRIVING REDUCED to “failure to obey traffic control device” with zero jail – State v. Mr. W. (DMC No. 6593) (Mesa City Court 2006045335):  Mr. W. was observed by a Mesa Officer approaching an accident scene with two patrol cars were blocking two of the lanes and half of the suicide lane.  Cones were set up which wouldn’t let anybody turn either right or left.   Mr. W. was observed driving around the patrol cars and attempting to go straight.  When he was stopped, Mr. W. stated that since no officers were directing traffic, he thought he could drive that direction.  We convinced the prosecutor to dismiss the “reckless driving” charge (which would have cost Mr. W. his license) in exchange for a simple traffic ticket.

State v. Mr. B. (DMC No. 6167)

REDUCED | AGGRESSIVE DRIVING REDUCED to “speeding” ticket with zero days jail – State v. Mr. B. (DMC No. 6167) (San Marcos Justice Court TR06-001660): A DPS Officer claims that he saw Mr. B. driving eastbound on the I-10 near the US-60 travelling up to 100 MPH. He also stated that while he was on his motorcycle, Mr. B. passed on the right shoulder and was weaving in and out of traffic without signaling.  He subsequently pulled him over and cited him for “aggressive driving”, which carries enough points to suspend Mr. B.’s license.  We were able to convince the prosecutor to reduce the charge to a “speeding” ticket, with zero days in jail.  Thereby saving Mr. B.’s license.

State v. Mr. S. (DMC No. 6623)

REDUCED | RACING ON ROADWAY REDUCED to “speeding” ticket with zero days jail – State v. Mr. S. (DMC No. 6623) (Peoria City Court TR2006-004458): A Peoria Police Officer claimed that he was at 8200 W. Paradise Lane when he heard two motorcycles revving their engines and driving on the roadway in excess of the 35 MPH speed limit. When he activated his lights, one motorcycle “popped a wheelie” and fled.  Mr. S. was obeying traffic laws and he pulled over properly.  We explained to the prosecutor that Mr. S. was not racing, and it was actually the other motorcyclist who was behaving dangerously.  Mr. S. did not know the other motorcyclist, and the prosecutor agreed to reduce the “racing on roadway” ticket down to a “speeding” ticket.  This saved Mr. S. from his license from being suspended.

State v. Mr. F. (DMC No. 6005)

DISMISSED | DRAG RACING DISMISSED – State v. Mr. F. (DMC No. 6005) (University Lakes Justice Court TR05-50712): A Maricopa County Sherriff’s Officer alleged that while working a DUI Task Force he observed two vehicle’s racing on Broadway Road.  He pulled over Mr. F. and claimed that he was drag racing with another car.  Mr. F. vehemently denied this charge.  We were able to convince the prosecutor that he may have been travelling fast, but he was not actively racing anybody.  All charges were dismissed.

State v. Mr. O. (DMC No. 4561)

REDUCED | DRAG RACING (while on probation) REDUCED to “speeding” ticket – State v. Mr. O. (DMC No. 4561) (Maricopa County Juvenile Court JV-537357): Mr. O. has been in front of the juvenile court system 4 previous times for traffic offenses prior to being charged with drag racing.  He was currently on probation for one of his prior charges when he came to see us.  We were able to convince the prosecutor to offer a reduced charge of a “speeding” ticket with some community service hours.  Mr. O. would have received enough points on his license with the drag racing conviction to cause a revocation of his driving privileges.  The disposition garnered saved him his ability to drive.

State v. Mr. J. (DMC No. 10279)

REDUCED | OUI (DUI on a boat, .074 BAC) REDUCED to reckless operation of watercraft with zero days jail – State v. Mr. J. (DMC No. 10279) (East Mesa Justice Court 2011-065748): Mr. J. was pulled over by MCSO Deputies for not displaying a ski flag while boating.  He subsequently was processed for DUI and was given a hand held breath test that revealed a .082.   A later test at the Bartlett Lake aid station revealed a .074 BAC.  Due to the questionable nature of the stop, we were able to have the charge reduced to a mere “reckless operation of watercraft” with no days in jail.

State v. Mr. K (DMC No.)

REDUCED | FELONY FLIGHT REDUCED to endangerment with zero days in jail – State v. Mr. K. (DMC No.) (Maricopa County Superior Court): Mr. K. was travelling on the freeway when officer’s got in behind him and attempted to pull him over.  He then exited the freeway and kept travelling into an intersection before he was stopped by other officer’s.  Mr. K. thought that the vehicle that was following him was an ambulance (it was actually a “Tahoe” police vehicle). Mr. K. was originally facing up to 2.5 years in prison on this class 5 felony, when we were able to get it reduced to an ENDANGERMENT “open” charge with probation and zero days jail.  At the conclusion of probation, the case was designated a misdemeanor, and Mr. K. has no felony on his record.
