DISMISSED |  DUI (.085 BAC) – State v. Ms. L. (DMC No. 4540) (El Mirage City Court CR04-157): Ms. L. had been drinking and became involved in an argument with her husband.  Eventually, he called 911 and she left because she was scared.  She was pulled over and asked to do a series of field sobriety tests.  She performed poorly because she was upset and confused. Subsequently she was taken to the station and provided a .085 breath test.  Due to issues with the breath testing device, and the questionable nature of the stop, we had all charges dismissed.
