EXTREME DUI (.171 BAC) REDUCED to REGULAR DUI with 1 DAY in JAIL – State v. Mr. R. (DMC No. 4607) (Mayer Justice Court TR2004-1423): Police were called out to the location of I-17 and Mile Post 265 near Mayer, Arizona regarding a disabled vehicle.  They were told that the driver hit a construction barricade and did not have a jack in order to fix his tire.  When the police arrived, they found Mr. R. in an intoxicated state, and he was arrested for DUI.  He eventually provided a breath test which showed a .171 BAC.  Because the Prosecutor was having trouble locating the 911 caller, we convinced the Prosecutor to dismiss the Extreme DUI in exchange for a regular DUI with 1 day in jail.  Originally Mr. R. was facing 30 days in jail.
