REDUCED | VEHICULAR AGGRAVATED ASSAULT REDUCED to disorderly conduct with 30 days in jail – State v. Mr. B. (DMC No. 4729) (Maricopa County Superior Court CR2004-040639): Mr. B. was accused of getting into an argument with a bicyclist.  He was seen driving on the sidewalk with his minivan in an attempt to run down the bicyclist.  He was subsequently arrested and charged with vehicle aggravated assault and faced a minimum 5 to 15 years in prison.  We presented evidence that Mr. B. was never within 10 feet of the alleged victim.  Because of this, we secured an offer to a disorderly conduct.  At sentencing, the judge could have gone up as high as 1 year in jail, but instead he only gave Mr. P. 30 days in jail.
