(San Tan Justice Court No. 03-09845CR): Mr. G. was stopped by Gilbert Police for allegedly speeding. Upon contact, the officer claimed he had an odor of alcohol and was traveling at 80 mph in a 65 mph zone. Mr. G. submitted to a breath test, which resulted in a low BAC, yet the officer stated that he performed poorly on Field Sobriety Tests. Due to the facts of the case and our threat of trial, we were able to dismiss the prosecutor to dismiss the DUI charges.
