State v. Ms. H (DMC No. 6196)

REDUCED | ARMED ROBBERY with a GUN (dangerous)/AGGRAVATED ASSAULT with a GUN (dangerous) REDUCED to PROBATION with 1 YEAR of JAIL and WORK FURLOUGH RELEASE – State v. Ms. H. (DMC No. 6196) (Maricopa County Superior Court CR2005-005735): Mr. H. was with several friends when he was driving down the road and saw the alleged victim in front of him in his car. He stated “there’s the guy that owes me money”, and he began tail gating the victim. His other friend was in another car, and they cut the victim off and stopped his vehicle in the roadway. Mr. H.’s friends then got out with a silver handgun and shotgun and demanded the money that he was owed. Police saw this, and a high speed chase ensued, and all were taken into custody. Mr. H. was facing a minimum of 10 years in prison, and a possible maximum of over 30 years. We were able to show through mitigation that he deserved a probation offer. Attached to that offer was 1 year of jail, with “work furlough” which allowed Mr. H. to complete school. The co-defendants were not as fortunate.

State v. Mr. P. (DMC No. 5002)

REDUCED | POSSESSION of DRUGS FOR SALE (1 pound marijuana; 17 grams of methamphetamine)/MONEY LAUNDERING/MISCONDUCT with WEAPONS and POSSESSION of DRUG PARAPHERNALIA REDUCED to SOLICITATION with PROBATION and ZERO DAYS in JAIL – State v. Mr. P. (DMC No. 5002) (Pinal County Superior City Court CR2004-01175): Detectives had been working with an undercover confidential informant who stated that Mr. P. had been selling drugs out of his house.  Police executed a search warrant, and then found 1 pound of marijuana, 17 grams of meth and a 9 mm handgun at Mr. P.’s location.  Mr. P. was questioned and made admissions, and then he was read his Miranda rights and made the same admissions again on tape.  Due to the improper questioning of Mr. P. pre Miranda, we were able to negotiate a plea agreement to a mere “solicitation to possess drugs”, which included probation with zero days in jail.  Originally Mr. P. was facing mandatory prison time for being above the threshold and having a gun on his possession while committing a drug crime.

State v. Mr. L (DMC No. 8481)

REDUCED | ILLEGALLY CONDUCTING an ENTERPRISE/PROMOTION of GAMBLING REDUCED to misdemeanor and PROBATION with ZERO DAYS JAIL – State v. Mr. L. (DMC No. 8481) (Maricopa County Superior Court CR2008-006017): Mr. L. and a group of gentleman had met at the local Indian casino, when they decided to begin having poker games (for profit) at a local condominium.  There were also allegations of drugs being sold in that location.  Although there were 38 co-defendants, we were able to show that Mr. L. was not the “kingpin” of the operation and we were successful in securing a misdemeanor plea of “benefiting from gambling”, which included probation and zero days in  jail.

State v. Ms. L. (DMC No. 5224)

REDUCED | FORGERY ($33,000) REDUCED to ATTEMPT with ZERO DAYS JAIL – State v. Ms. L. (DMC No. 5224) (Maricopa County Superior Court CR2005-009970): Ms. L. was accused of possessing $33,000 and forged/counterfeit money.  We were able to demonstrate that the co-defendants (which included her boyfriend) were the ones who were actually producing the money and selling drugs.  Due to just her peripheral involvement, we were able to have the case moved down to a simple “attempt” with probation and zero day’s jail. The co-defendants received much harsher pleas.

State v. Mr. M (DMC No. 254)

REDUCED | FRAUD SCHEMES/FORGERY REDUCED to ATTEMPTED THEFT class 6 open/MISDEMEANOR with PROBATION and ZERO DAYS JAIL – State v. Mr. M. (DMC No. 254) (Maricopa County Superior Court CR97-95494): Mr. M. was accused of ordering computer equipment and having it delivered to a local resort in Scottsdale.  He would then present a fake cashier’s check as a “C.O.D.” and then keep the items.  Detectives had been monitoring him and took him into custody when he attempted to do it another time. We were able to have the case reduced from “fraud schemes” and “forgery” to a simple “attempted theft” which turned into a misdemeanor after completion of probation.  No jail time was involved.

State v. Mr. P (DMC No. 5223)

NOT CHARGED | FORGERY – State v. Mr. P. (DMC No. 5223) (Arizona Attorney General’s Office Investigated): Mr. P. was being represented for a potential burglary charge when the Attorney General’s Office began investigated him for forging false vehicle emission documents.  We became involved, and prevented the AG from speaking with Mr. P.  We also argued that these documents could have been obtained by people prior to Mr. P. possessing them.  Ultimately, no charges were brought for the forgery allegations.  If Mr. P. had been charged and convicted, he could have been facing many years in prison due to his prior burglary charge.

State v. Ms. P (DMC No. 5682)

DISMISSED | THEFT – State v. Ms. P. (DMC No. 5682) (Phoenix City Court 3171368): Ms. P. worked at a Marshall’s department store, when she was arrested by Loss Prevention Officer’s for allegedly “skimming” money from the till.  She confessed to stealing $1,500 over a 4 month time span. This alleged confession was both written and on video tape.  The State was unable to comply with our Discovery request to produce the video tapes and notes, and they were forced to dismiss the case in its entirety.

State v. Mr. S (DMC No. 4814)

REDUCED | COMPUTER TAMPERING/ATTEMPTED THEFT REDUCED to POSSESSION of ACCESS DEVICE class 6 open/MISDEMEANOR with PROBATION and ZERO DAYS JAIL – State v. Mr. S.  (DMC No. 4814) (Maricopa County Superior Court CR2004-014804): Mr. S. had made contact with an undercover Detective in order to purchase a cable access card that would allow him to get free cable.  This allowed him to secure hundreds of dollars worth of programming and NFL games on a monthly basis.  When he was finally arrested by the Detectives, he was taken into custody and had to post bond.  He then contacted us and we were able to negotiate with the Prosecutor to get the case reduced down to a class 6 open with probation and zero day’s jail.  Upon the completion of probation, the case was designated a misdemeanor, and Mr. S. has no felony conviction on his record.

State v. Mr. Z. (DMC No. 5452)

DISMISSED | BAD CHECKS CHARGE – State v. Mr. Z. (DMC No. 5452) (Downtown Justice Court CR03-00759): Mr. Z. was accused of writing checks which totaled $5,750.  After he was arrested and posted bond, he hired us to fight the case.  We were able to work with the original the payee and have the entire charge dismissed in full.

State v. Ms. F (DMC No. 10148)

REDUCED (ALL) | MORTGAGE FRAUD/FORGERY REDUCED to a class 6 open/misdemeanor with PROBATION and ZERO DAYS JAIL – State v. Ms. F. (DMC No. 10148) (Maricopa County Superior Court CR2011-107402): Ms. F. was accused of over inflating her income on her residential real estate loan in order to secure a house.  Eventually, the economy turned bad and the house was forfeited back to the bank.  When it was discovered that she had falsified her loan application (i.e. a “liar’s loan”), and she was charged with “felony forgery” and “felony mortgage fraud”.  We were able to get the case reduced to a simple “possession of forgery device” class 6 open/misdemeanor with probation and zero day’s jail.  The case was later designated as a misdemeanor and Ms. F. has no felony on her record.
