State v. Ms. S. (DMC No. 102979)

NOT CHARGED | CHILD ABUSE NOT – State v. Ms. S. (DMC No. 102979) (Surprise Police Department Investigated): Ms. S. had a particularly difficult daughter who was 16 and had run away numerous times. She also abused alcohol, and would cut and burn herself. On one of the times she had run away, when police found her she claimed that her mother had been abusing her. She showed previous marks on her arms (which were self inflicted) as so called “evidence”. We subsequently presented the Deputy Maricopa County Attorney with Facebook posts, and a CPS report in which the daughter admitted to lying. Ultimately, no official charges were brought against Ms. S.

State v. Mr. I (DMC No. 4753)

NOT CHARGED | CHILD ABUSE – State v. Mr. I. (DMC No. 4753) (Gilbert Police Department and CPS Investigated): Mr. I. had 2 biological children and 5 foster/adopted children. Some of them arrived with varying behavioral issues. As 2 of the girls became older teenagers, they made allegations of abuse in order to move out of the household. We were able to show CPS and Detectives that the 2 girls were known to fabricate stories, and there was no corroborating physical or testimonial evidence. We were able to show the Prosecutor that none of the allegations were substantiated and no charges were ever brought against Mr. I.

State v. Mr. H (DMC No. 6699)

NOT CHARGED/DISMISSED | AGGRAVATED ASSAULT with a GUN (dangerous) NOT CHARGED/DISORDERLY CONDUCT with a GUN (dangerous) DISMISSED – State v. Mr. H. (DMC No. 6699) (Maricopa County Superior Court CR2006-030697): Mr. H.’s wife went to the police station and stated that 3 days earlier her husband had threatened her with a gun, demanding to know who had been texting her on her phone. When police went to question Mr. H., he denied that he pointed the gun at her, and instead that he pointed it at himself and threatened to commit suicide. He was arrested for Aggravated Assault (Dangerous) with a gun. We convinced the Prosecutors charging bureau to only charge Mr. H. with the lesser of Disorderly Conduct (Dangerous) with a gun. During the pendency of the case, we presented evidence that Ms. H.’s story kept changing, and in addition, she no longer desired prosecution. Due to various other issues, the State moved to dismiss all charges in full. Originally, Mr. H. was facing 5 to 15 years for the Aggravated Assault, and 1 ½ to 3 years for the Disorderly Conduct (Dangerous). He now has nothing on his record.

State v. Mr. G (DMC No. 6701)

NOT CHARGED | AGGRAVATED ASSAULT with BRASS KNUCKLES (dangerous) – State v. Mr. G. (DMC No. 6701) (Mesa Police Department DR2005-2380646): Mr. G. and a group of other juvenile’s were in a car when they allegedly confronted another car and a mass fight broke out. Mr. G. was accused of striking a male in the back of the head with brass knuckles. He later needed to go to the hospital and received stitches. We were able to show that some of the witnesses identified the person with the brass knuckles as a Hispanic male, as whereas Mr. G. was white. We were able to convince the Prosecution to not file charges. Mr. G. could have been facing 5 to 15 years in prison.

State v. Ms. M (DMC No. 5654)

NOT CHARGED | VEHICULAR AGGRAVATED ASSAULT (dangerous)/CRIMINAL DAMAGE – State v. Ms. M. (DMC No. 5654) (Maricopa County Booking P018038/Goodyear Police Department DR2004-00006748): Ms. M. was an 18 year old female who had psychiatric problems, and she was arguing with her mother and brother. She was taking anti-depressants, and had recently lowered the dose just before the incident. She was threatening to kill herself with a knife and the police were called. As she was leaving in her car, her mother got behind the vehicle and was struck. When the police arrived, they saw various items broken inside the house and they charged Ms. M. with “Criminal Damage” and “Vehicular Aggravated Assault” (dangerous). She was arrested and was facing 5 to 15 years on the Aggravated Assault charge alone. We were able to intervene with Prosecutor and convince them to not move forward with the charges. Ms. M. has no convictions on her record.

State v. Ms. R (DMC No. 6107)

NOT CHARGED/REDUCED | FELONY MANSLAUGHTER NOT CHARGED/MISDEMEANOR MANSLAUGHTER REDUCED to PROBATION with 100 HOURS of COMMUNITY SERVICE – State v. Ms. R. (DMC No. 6107) (West Mesa Justice Court CT2006-002295/Salt River Police Department DR2005-06294): Ms. R. had been driving near McKellips & Alma School Road in Mesa, when she made a u-turn. Another vehicle had been coming through the intersection and struck her. The driver of that vehicle died. As police contacted her, she had indicated she had drank 3 ounces of wine several hours prior, and had taken some prescription medication two days earlier. They subsequently had her sign a contract that voluntarily give blood, and we then became involved. We were able to prove with an “accident reconstruction” and blood analysis that she was not impaired, and that the accident was not her fault. The Maricopa County Attorney’s Office declined to file the felony manslaughter charge. She was, however, charged with “misdemeanor manslaughter”. We were able to have that reduced to 100 hours of community service. She was originally facing 7 to 21 years in prison, and ended up with no felony on her record and not having to do jail time.

State v. Mr. P (DMC No. 6506)

NOT CHARGED | CHILD MOLESTATION State v. Mr. P. (DMC No. 6506) (Mesa Police Department Investigated): Mr. P.’s wife had filed an Order of Protection and claimed that he had sexually abused their daughter. His wife had had problems in the past, and was charged with trying to drug and murder the children. She was placed on probation and given mental health terms. 7 years had passed, and she now made these false allegations. We had Mr. P. take, and pass a polygraph test, and we turned over to Detectives Mrs. P.’s prior history. The Detective in charge of the case agreed to clear all charges.

State v. Mr. & Mrs. S (DMC No. 5827 & 5828)

NOT CHARGED | SEXUAL CONDUCT with a MINOR/CHILD MOLESTATION – State v. Mr. & Mrs. S. (DMC No. 5827 & 5828) (El Mirage Police Department Investigated): Mr. & Mrs. S. took their daughter to the hospital because she had scratched herself and was bleeding near her vagina. Hospital staff accused them of molest, and the police were called. CPS took their daughter away to foster care, and we became involved. We had them both take, and pass a polygraph test and we explained the same to CPS. They got their daughter back and no charges were ever brought against them.

State v. Mr. L (DMC No. 6049)

NOT CHARGED | CHILD MOLESTATION – State v. Mr. L. (DMC No. 6049) (Phoenix Police Department Investigated): Mr. L. lived in an apartment complex, and was currently on disability when he befriended a neighbor who had a 3 year old daughter. They became friends over time, and eventually he would babysit the neighbor’s daughter while she was out town. Approximately 6 months after he had babysat the daughter, allegations of child molest surfaced. We had Mr. L. take, and pass a polygraph test. In addition, we discovered that the neighbor’s ex-husband was in prison, and had been released about 2 months after Mr. L. had last babysat the child. We conducted a “free talk” with the Detective and Mr. L. at the police station. It became apparent that Mr. L. had given the 3 year old a bubble bath during one of the overnight babysitting sessions. The father (who just been released from prison) was unstable, and made these allegations. The Detective viewed the polygraph results and no charges were brought against Mr. L.

State v. Mr. B (DMC No. 6250)

NOT CHARGED | CHILD MOLESTATION – State v. Mr. B. (DMC No. 6250) (Phoenix Police Department Investigated): Mr. B. was a 71 year old man who had purchased his 36 year old niece a car in exchange for a $5,000 promissory note. The niece quit paying on the note, and after she had her second child out of wedlock she demanded he forgive the $5,000 note, and give her another $5,000 for “molesting me when I was 5”. We had Mr. B. take, and pass a polygraph test. We also provided the promissory note, along with the polygraph results to the Detectives. When they confronted the alleged victim, she quickly discontinued all contacts with police. The Detective ruled “there is no evidence to support an allegation of molest”, and closed the investigation.
