State v. Mr. H (DMC No. 9800)

DISMISSED – Hit and Run, State v. Mr. H. (DMC No. 9800) (Phoenix Police DR# 2010-01460055): Mr. H. was 18 years old and was driving to a friend’s house, when a light turned green and he began driving. A gentleman stepped in front of his car, and was bumped by the car and did not fall to the ground. The two exchanged words and Mr. H drove away. A police report was taken claiming that the alleged victims suffered a swollen wrist and that there was a Hit and Run. We were able to convince the Police Officers that this did not qualify as a true Hit and Run case, and they did not route the case for prosecution to the City of Phoenix Prosecutor’s Office.

State v. Mr. H (DMC No.7311)

REDUCED | RECKLESS DRIVING REDUCED TO AGGRESSIVE DRIVING – State v. Mr. H. (DMC No.7311) (Phoenix Municipal Court No. 13669073): Mr. C. was charged with Reckless Driving, Speeding, Unsafe Lane Change and Tailgating. Although he was facing enough points to suspend his license for more than 6 months, we were able to secure a plea to a simple Aggressive Driving ticket which involved no license suspension. This was important because Mr. H. had prior convictions for Under Age Drinking and Driving and Driving on a Suspended License. He also had a business in which he could not afford any license suspension.

State v. Mr. R (DMC No. 7060)

State v. Mr. R. (Phoenix Municipal Court No. 3598412): Mr. R. was charged with Public Sexual Indeceny. Police claimed they had gone in plainclothes into an adult theater in order to do an inspection. While they checked in a “single person booth,” they saw our client watching a video and allegedly masturbating. We explained to the prosecutors that this did not really fit into the definition of Public Sexual Indecency due to the fact that no reasonable person would be surprised by seeing that type of behavior in that location. The State dropped the Sex Crimes allegations and reduced the charge to Disorderly Conduct with no jail.

State v. Mr. N (DMC No. 10129)

COMPLETE ACQUITTAL at BENCH TRIAL | 2 COUNTS OF ASSAULT/DOMESTIC VIOLENCE – State vs. Mr. N. (DMC No. 10129) (City of Phoenix Case No’s: 4282142 & 4366345): Mr. N. had been having arguments with his wife due to her showing up at his office dressed inappropriately and spending grocery money on shoes. His wife had previously attempted to commit suicide and threatened to burn down the house with him and the kids in it. She started a fire in the bathroom and he put it out and argued with his wife some more. She eventually called police and claimed that he had assaulted her on two different occasions. Mr. N. was charged with two separate crimes of domestic violence assault, and after a lengthy Bench Trial, we were able to convince the judge find a verdict of Not Guilty on both counts.

State vs. Mr. S (DMC No. 9895)

DISMISSED at BENCH TRIAL | Hit & Run (DMC No. 9895) (City of Phoenix No. 4246005): Mr. S. was backing out of a parking lot when he had bumped into another car and drove away. He did not realize he had actually bumped another car and did not see any damage on his vehicle. He had very heavily tinted windows. On the day of trial, the alleged victim could not positively identify Mr. S. as the driver of the vehicle and the prosecution dismissed all charges.

State v. Ms. L (DMC No. 4617)

NOT GUILTY/COMPLETE ACQUITTAL at BENCH TRIAL | ASSAULT – State v. Ms. L. (DMC No. 4617) (Phoenix City Court 3001550): Ms. L. was in from out of town with her husband at a hotel bar where she consumed numerous drinks. An argument ensued between Ms. L., her husband and two other gentlemen at the bar. As she was leaving, she was grabbed on the shoulder from behind and she turned and punched a woman in the face.

The woman, who was also from out of town, submitted $5,000 worth of medical bills claiming they were a result from this incident. We were able to show that numerous prescriptions and diagnosis were submitted from before this incident. In addition, we were able to show that Ms. L. acted in self-defense. The Judge acquitted Ms. L. of all charges.

State. Vs. Mr. H (DMC No. 9374)

State. Vs. Mr. H. (DMC No. 9374) (City of Phoenix Court No. 2009-900173801): Mr. H. was driving with a friend when his vehicle went into a ditch and crashed. When police arrived, they met with Mr. H.’s friend; Mr. H. told several different stories about what had occurred and who was driving. Independent witness stated that he heard the accident and came out to see two gentlemen walking quickly away from a black BMW. He heard one of the men say to the other man that he was going to come back to get his car before the police arrived. Due to the fact that the independent witness was not able to say which one of the two men was driving the car, combined with deviations in the alleged passenger’s story, we were able to convince the prosecutor to dismiss all charges.

State vs. Mr. P (DMC No. 8691)

DISMISSED | BOMB THREAT – State vs. Mr. P. (DMC No. 8691) (Phoenix Police Report No. 2008-81850649): Mr. P. had been frustrated when dealing with Bank of America regarding his credit card statement and balance. Bank employees reported that Mr. P. called in and stated if they did not give him credit for his airline miles that he was “going to bomb the Phoenix office”. He was eventually arrested and taken into custody. We were able to talk with the charging attorney at the Maricopa County Attorney’s Office and they agreed that based on Mr. P.’s mental state and stressors in his life, they were not going to proceed with criminal charges.

DISMISSED at JURY TRIAL | SHOPLIFTING – State v. Mr. R. (DMC No. 5248) (Phoenix City Court 3204962): Mr. R. was accused of going to a Robinson’s May store and picking up a water purifier from the sales floor, then taking it to the front register to try to and return it. Loss Prevention Officer’s stated they had recognized him from previous incidents, and he was arrested for shoplifting. The case was set for jury trial, and at the time of trial the State could not meet its burden with the proper Loss Prevention witnesses. The case was dismissed in its entirety.

State v. Mr. F (DMC No. 4908)

DISMISSED at JURY TRIAL | DUI (.070 BAC) – State v. Mr. F. (DMC No. 4908) (Phoenix City Court 3040345) [December 4, 2004]: Mr. F. was observed driving 85 to 90 mph, when he was weaving in and out of traffic and slammed on his brakes. A fully marked DUI van almost rear ended Mr. F. as they were “pacing” him. He was subsequently arrested for DUI and provided a .070 BAC. At trial, as jury selection was nearing an end, the Prosecutor realized that it did not look favorable and dismissed all charges.
