State v. Ms. S. (DMC No. 10775)

DISMISSED | SUPER EXTREME DUI (.237 BAC) DISMISSED – State v. Ms. S. (DMC No. 10775) (Mesa City Court 2011-069344): Ms. S. was involved in a minor traffic accident, and when police arrived they stated she was “out of it” with slurred speech.  She was currently taking medication for diabetes and high blood pressure.  After a blood draw, her blood came back at a .237 BAC.  We were able to show that Ms. S. was not competent to face charges, and the State moved to dismiss in order to route the case to the Maricopa County Superior Court “Rule 11” Division in order to determine competency.  Ms. S. was deemed to be incompetent and all charges remained dismissed.

State vs. Mr. J. (DMC No. 9651)

State vs. Mr. J. (DMC No. 9651) (Mesa City Court No. 2010-02531): Mr. J. was stopped for making an improper right hand turn.  Upon contact, the Officer claimed that he had dilated pupils, eyelid tremors and slow speech along with watery and blood shot eyes.  Mr. J. admitted to smoking marijuana earlier in the day, but he also told the officer that he has a “mass on his brain”.  He was 6 foot 2 inches, and weighed 300 pounds and was put through various field sobriety tests and a drug recognition evaluation.  His urine eventually came back with 28 nanograms (1 millionth of a gram) of inactive marijuana metabolites.  They also ran the urine test with only half of the normal amount of urine.  Based upon all of these issues, we were able to convince the prosecutor to dismiss the case in its entirety.

State V. Mr. D (DMC No. 9909)

(DMC No. 9909) (Mesa City Court No. 2010-001867): Mr. D. was seen driving without his headlights on. He turned into a Circle K and was contacted by an officer. Subsequently a DUI investigation ensued and a blood test was conducted which revealed a .198 blood reading. Mr. D. had asked for an attorney, and was not allowed to contact one. An Evidentiary Hearing was set regarding denial of right to counsel, and the state dismissed all charges at that time. Mr. D. was originally facing over 30 days in jail.

State v. Ms. P.

DUI DISMISSED – State v. Ms. P. (Mesa Municipal Court No. 2002025698): Ms. P. was pulled over for driving in the bike path and almost hitting a sidewalk. Upon being contacted by the officers, she admitted she’d had one drink and also had some prescription drugs in her system. She later wrote a letter to the judge apologizing for driving “impaired.” After we took over the case, we were able to show the prosecutor that the prescription drugs in her system were legal, and that they would be hard-pressed to beat us in a trial to convince a jury she was impaired by those drugs. The prosecutor then moved to dismiss all charges.

State v. Ms. B (DMC No. 6168)

REDUCED | DUI DRUGS (Diazepam & Clonazepam) REDUCED to Reckless Driving – State v. Ms. B. (DMC No. 6168) (Mesa City Court 2005075572): Ms. B. was accused of swerving all over the road by an unknown 911 caller in the location of Baseline & Gilbert Road.  After being stopped by police, she was accused of being under the influence of Diazepam & Clonazepam although Ms. B. admitted to taking prescription medications, no drugs were found in her system.  The case was ultimately reduced to a mere reckless driving with zero days in jail.

State v. Mr. R. (DMC No.)

REDUCED | DUI (.088 BAC) (030053CR): Mr. R. was stopped by Mesa Police during an East Valley DUI Task Force. The officer claimed his headlights were not on. He subsequently provided a blood sample which revealed .088 BAC. After all defense interviews were complete, we convinced the prosecutor the State would probably not prevail at Jury Trial and were able to secure a plea to Reckless Driving with zero days in jail.

State v. Mr. W (DMC No. 10168)

NOT CHARGED/DISMISSED | AGGRAVATED DUI NOT CHARGED/MISDEMEANOR DUI – State v. Mr. W. (DMC No. 10168) (Mesa City Court 2008-046536): Mr. w. was accused of taking a large U-Haul truck through a fast food drive thru and striking the roof.  When police arrived, they contacted Mr. W. outside of his vehicle and he invoked his right to counsel.  Mr. W. was unable to contact an attorney. The City Prosecutors Officer mistakenly accused Mr. W. of having a suspended driver license for a previous DUI.  They then dismissed the misdemeanor in order to route the case for felony charges.  Due to the fact that Mr. W. did not have a suspended license, the fact that he had problems reaching an attorney, and the fact that the State had trouble contacting the witness who was to place Mr. W. behind the wheel, no felony charges were ever brought against Mr. W., and the misdemeanor statute of limitations ran.

State v. Mr. R (DMC No.)

(Mesa Municipal Court No. 2003075844CR): Mr. R. was stopped for allegedly making a wide right turn. When the officer stopped him, he claimed he had watery, bloodshot eyes and an odor of alcohol. During the eye test (HGN), Mr. R. exhibited only 4 cues out of 6, and he had a knee injury. Due to the fact that he had a low BAC, combined with our arguments to the prosecutor about his good performance on the remaining FST’s, the State dismissed all charges.

State v. Ms. B. (DMC No.)

(Mesa Municipal Court No. 2003079934CR): Ms. B. was stopped for allegedly making a wide right turn.  The Mesa Police Officer who stopped her claimed she had slurred speech and bloodshot, watery eyes.  On the eye test (HGN), she exhibited only 4 cues.  She tried to explain that she had a broken toe and took medication for asthma, which may affect her eyes, yet she was still arrested for DUI in Mesa.  Due to her low BAC, combined with the medical records we provided to the prosecutor, we were able to have all charges dismissed.

State v. Mr. E. (DMC No.)

DUI DISMISSED – State v. Mr. E. (Mesa Municipal Court No. 2006059355): Mr. E. pulled up to a 7-11 store at 815 S. Dobson Rd. Various people called police because they felt he was impaired. When officers arrived, he was seen exiting the 7-11 with a handgun tucked in his back pocket. Officers subsequently arrested him for DUI and pulled the security footage showing him driving up to the 7-11. Once he was taken to the station he spoke to our attorney via telephone and then requested to have an independent blood test. The officers told him that they would deal with it down at the jail, and he was booked overnight. The jail staff never helped him secure an independent test, and we were able to file a Motion in which the judge dismissed all charges.
