DISMISSED | EXTREME DUI (.158 BAC) State. vs. Mr. P. (DMC No. 9888) (Litchfield City Court No. TR10-400CR): Mr. P. was stopped for travelling 64 m.p.h. in a 45 m.p.h. on radar. The officer also claimed he was weaving within his lane. He was eventually stopped and he told the officer he had a neck and spine injury from a previous car accident. He eventually gave a breath test which revealed a .158 breath alcohol content. Due to the questionable field sobriety test based on his neck injury, we were able to reduce the Extreme DUI from 30 days in jail to a Regular DUI with 1 day in jail.
