DISMISSED | BAD CHECKS CHARGE – State v. Mr. Z. (DMC No. 5452) (Downtown Justice Court CR03-00759): Mr. Z. was accused of writing checks which totaled $5,750. After he was arrested and posted bond, he hired us to fight the case. We were able to work with the original the payee and have the entire charge dismissed in full.
AGGRAVATED ASSAULT on a Cop/RESISTING ARREST REDUCED to MISDEMEANOR DISORDERLY CONDUCT with ZERO DAYS JAIL – State v. Ms. J. (DMC No. 722) (Downtown Justice Court CR97-05265FE): Ms. J. was at a party and had been drinking while on prescription medication, when she ended up getting into a fight with another girl. She suffered a head injury, and did not recall a lot of what occurred. Police claimed that when they arrived, she assaulted the officers and was resisting arrest. We were able to present medical records that she suffered a concussion in the fight, and the State agreed to reduce charges down to a simple misdemeanor with zero days in jail. She has no felony on her record.
NOT CHARGED | DISORDERLY CONDUCT NOT CHARGED – State v. Ms. H. (DMC No. 5220) (Downtown Justice Court A542730/Maricopa County Sheriff’s Office DR03-27349): Ms. H. was at a Diamondback’s baseball game with her boyfriend, when he got involved in a fight and was arrested. She went to follow him into the police holding area, when deputies stopped her. She was told to leave the area and subsequently came back. She demanded to have officer’s names, and began shouting profanities. She was placed under arrest for disorderly conduct. We convinced the Prosecutors that this case did not actually rise to the level of disorderly conduct, as Ms. H. merely emphasized to have the officer’s names while using bad words. They agreed, and no charges were filed on Ms. H.
State v. Ms. S. (Downtown Justice Court No. 03-02414CR): Ms. S. was seen travelling the wrong way on a one way street in downtown Phoenix. She was ultimately contacted and performed poorly on field sobriety tests. She provided a breath BAC of a .159, and then she was questioned by police. Because she was a juvenile, they did no read her her juvenile Miranda Rights and we threatened to have all statements thrown out, along with the breath test. The state then offered a plea to Minor Driving with Alcohol in System.
