EXTREME DWI (.154 BAC) REDUCED to REGULAR DUI with 1 DAY in JAIL– State v. Mr. R (DMC No. 9645) (Parker Justice Court CR2010-0197): Mr. R was seen traveling 56mph in a 20mph zone near Riverside Drive and Resort Road in Parker, Arizona. After he was stopped, the Gang Task Force Officer who stopped him called in a DUI Officer to process Mr. R for DUI. Mr. R was an educated business man who had no ties to gang activity, and his stop by the Police was very suspicious. Although he was tested for alcohol, which revealed a .154 BAC, we were able to have the State agree to Reduce the charge to a Regular DUI with only 1 day in jail. Originally Mr. R was facing an Extreme DUI with 30 days in Jail.
