US v. Mr. S (DMC No. 18008) – Forfeiture ($39,375 Ford Explorer) – Dismissed (and Vehicle Returned) – US Customs and Border Patrol Investigated (Case No. 2022-265400061101)
Ms. S was the owner of an LLC that rented various vehicles on the Turo carsharing marketplace app. This was an app which is similar to Airbnb or VRBO, except instead of homes, it allows people to rent their cars. One of these vehicles was rented to a young lady, who was stopped at the Border Patrol checkpoint near Wilcox, Arizona, and was discovered to have potential illegal aliens inside of her vehicle. She was immediately Arrested, and the car was Seized and put up for Forfeiture. This is when Mr. S secured the services of DM Cantor.
We immediately filed a Petition for Remission of Forfeiture, and contacted the appropriate Deputy Assistant United States Attorney. After we explained all of the facts involved, and proof that Mr. S had no knowledge how his vehicle was being used, the Government agreed to Drop the Forfeiture and Return Mr. S’s Asset.
