Ms. R (DMC No. 8214) (Moon Valley Justice Court JC2007-157045): Ms. R lived in West Phoenix and had a pool that she did not use. Neighbors would hop the fence and jump in the pool, and it became an attractive nuisance. She subsequently drained the pool and it later accumulated debris inside. After several heavy rains, mosquitoes began to breed inside the pool and neighbors complained. Subsequently, a search warrant was executed and she was cited for Standing Water Likely to Breed Mosquitoes under Maricopa County Health Code Chapter 3, Regulation 2. Ms. R eventually had the pool filled in. The Maricopa County Attorney’s Office would not extend any offers, and the case was set to a Bench Trial. At the time of the Bench Trial, the Prosecutor decided to dismiss all charges against Ms. R.
