State v. Ms. J (DMC No. 16513) – (5 Counts) Felony Fraudulent Schemes ($165,842), Felony Theft, and Felony Forgery – Reduced (to 1 Year, 11 Months Actual DOC) – Maricopa County Superior Court (Case No. CR2018-006395)

Ms. J was an insurance agent who owned her own brokerage and sold Worker’s Comp policies to various businesses. At one of her jobs, she kept the premium, and did not pay for the client’s policy. Ultimately, the Department of Insurance Revoked her License to sell insurance. She then opened a second firm (even though she was not licensed), and took in $165,842 for premiums that she never sent to the various insurance companies. Eventually, this all came out after one of her clients called the insurance company, and they had no knowledge of Ms. J. Ms. J was subsequently Arrested, immediately Invoked her Right to Remain Silent and secured the services of DM Cantor.

We immediately began putting together a Mitigation Package regarding Ms. J’s mental state and various difficulties she was having within her life. We also had friends and family who wrote letters on her behalf to show that she was a good person, who had never committed crimes before, but had unfortunately become desperate for money.

We then went to a Settlement Conference, presented all this evidence to the Prosecutor. Although Ms. J was facing potentially well over Ten Years in Prison, they agreed to extend a Plea Agreement which included 1 year and 11 months of Actual DOC, Probation, and an up-front Restitution payment of approximately $30,000. If Ms. J was originally Convicted of all Charges, she could have spent well over 10 Years in Prison. Instead, she was Released from DOC and Successfully Completed Probation, and is moving successfully with her life.
