State v. Mr. Z (DMC No. 16172) – Felony Sexual Abuse (81-Year-Old Adult/9-Year-Old Minor) Dangerous Crimes Against Children – Not Charged/”Unfounded” – Maricopa County Sheriff’s Office Investigated (IR No. 20XX-XXXXX6)
Mr. Z was an 81-year-old male living in Sun City, Arizona, who attended a birthday party for the extended family of a grandchild. While he was at the birthday party, some kids made a mess with a cupcake, and Mr. Z and his wife helped clean it up. Sometime after the party was over, a 9-year-old niece made allegations that Mr. Z had touched her between the breasts and on the vagina. The alleged Victim’s Father immediately called and confronted Mr. Z, who Denied all Allegations. Immediately after this, he secured the services of DM Cantor.
Once we became involved, we confirmed that a Police Report was filed with Maricopa County Sheriff’s Office. We had Mr. Z take a Polygraph, in which he “passed”. We then sent over an Invocation of Mr. Z’s constitutional Right to Remain Silent, and a “Trebus/Bashir” Letter, which contained the passed Polygraph and all denials of the allegations. The Detectives then reviewed the case, and saw that we interviewed almost 15 other people who are alleged to have been in the room when this occurred. Nobody else saw anything, heard anything, nor were they told anything had happened. It was at this point the case was “Unfounded” by the MCSO Detective. Had Mr. Z been Charged and Convicted, in essence, this would have meant spending the Rest of his Life in Prison (given his advanced age).
