HIT AND RUN NOT CHARGED – State v. Mr. W. (DMC No. 6730) (Phoenix Police Department investigated): Mr. W. was involved in a rear-end accident, in which he walked away and left his vehicle. Police recovered his cell phone and business cards and attempted to question Mr. W. We intervened on his behalf and invoked his 5th Amendment rights. Ultimately insurance information was exchanged under the “permissive use statute” and the woman was paid for the damage to her car by Mr. W.’s insurance company without Mr. W. having to admit that he drove.
