URINATING in PUBLIC DISMISSED – State v. Mr. W (DMC No. 4977) (Scottsdale City Court 2004-20923): A Police Officer in the City of Scottsdale was at the 7300 block of Stetson Drive. He observed Mr. W pull up in his vehicle, parked and exit the vehicle. He then saw him urinate against a wall. The Officer (who was on horseback) then road up and made contact with Mr. W. He subsequently cited him for Urinating in Public per the Scottsdale City Code SRC 19-19. Due to the fact that Mr. W attempted to find a private spot, and that the Officer was somewhat hidden in a corner of a parking lot, we were able to show that he was not intentionally urinating “in public”. The Prosecutor agreed and dismissed all charges against Mr. W.
