State v. Mr. W (DMC No. 16315) – Felony Embezzlement ($200,000), Felony Fraudulent Schemes, and Felony Theft – Not Charged (Due to Cooperation Deal) – Show Low Police Department investigated (DR No. 20XX-XXXXX3)

Ms. W worked at a stone and marble sales business in Northern Arizona. One day he showed up to work, and an Officer from the Show Low Police Department was waiting for him along with his boss. He was read his Miranda Rights, and he admitted that was giving unapproved discounts to customers for about a year and a half. He also stated that he thought these totaled around $30,000 to $40,000 in discounts, and that he took home about $10,000 of that money. He was promptly fired from the business, and that’s when he secured the services of DM Cantor. 

During the investigation, the owner of the company stated there was approximately $200,000 of Theft which had occurred from the company. He stated that Mr. W was selling stone “off the back dock” and covering up the Theft by calling them “pallet returns”. We were able to show that at most, there might have been $20,000 taken, but no more. We also demonstrated that our Client had serious health issues, and he ultimately received a kidney transplant due to these issues. This is why the money he took was used for healthcare expenses. Ultimately, we were able to work out an Agreement with the owner where he agreed that he did not wish to seek nor aid in Criminal Prosecution. Had Mr. W been Charged with these Crimes, due to the Theft amount being above $100,000, he would have had to spend Mandatory Time in Prison. Because of our efforts, he has No Criminal Conviction, and his Record is Clean.
