State v. Mr. U (DMC No. 16997) – (2 Counts) Felony Child Molestation (Dangerous Crimes Against Children) Involving a Position of Trust (53-year-old Adult/13-year-old Minor), Felony Sexual Conduct with a Minor (DCAC), Felony Sexual Abuse of a Minor (DCAC), and Felony Aggravated Assault of a Minor (DCAC) – Reduced to Attempt and Probation (with 4 Years and 2 Months Actual DOC) – Pima County Superior Court (Case No. CR20XX-XXX2) 

Mr. U was a 53-year-old teacher at a music school who had been teaching a young student from eighth grade through freshman year. He was accused of inappropriately kissing and touching her while she was the age of 13 and 14. At one point, the student set up a cellphone in order to video some of the contact between the two of them at the school. She then showed the Principal at her school, and her parents, and the Police became involved. 

The first thing the Detectives did was have her call Mr. U and conduct a “Confrontation Call”, which was recorded. He was alleged to have made various admissions during this phone conversation about various incidents that had occurred. The next day, he showed up to work and was immediately Arrested. He was questioned by Detectives, and shown a portion of the video that the girl had taken, and was alleged to have made more admissions. After he was released from Custody, he secured the services of DM Cantor. 

We immediately obtained copies of all of the Police Reports and evidence involved in the case. In addition, we began our Mitigation process which included obtaining a Psychosexual Risk Evaluation, and placing Mr. U into Counseling. Lastly, we worked with the alleged Victim’s Civil Attorney who had filed a lawsuit against the school that Mr. U had worked for. Ultimately, we were able to obtain an Offer at a Settlement Conference to Attempt and Probation (which included 4 years and 2 months of actual Prison time). If Mr. U had proceeded to Trial and was Convicted on all Counts, he would have spent the Rest of his Life in Prison.
