State v. Mr. S (DMC No. 17658) – Felony Failure to Report a Sex Crime as a Mandatory Reporter (11-year-old Minor/33-year-old Adult) Dangerous Crimes Against Children, and Felony Child Abuse/Neglect – Not Charged/”Case Closed” – Phoenix Police Department Investigated (DR No. 20XX-XXXXXXXO)

Mr. S had gone through a Divorce and was in a Custody Battle with his ex-wife. The ex-wife claimed that their 11-year-old daughter had made accusations against Mr. S’s brother (the child’s Uncle), and claimed that Mr. S knew about this, but did not report the Uncle to the Police. Once these allegations were made, the girl was interviewed at the Family Investigation Bureau by a Phoenix Police Detective. During that interview, she said for approximately four years the Uncle had been touching her inappropriately, and that at one point he had “raped” her. 

During a second interview, she claimed that she told her grandmother and her father, but they told her not to say anything, because then she wouldn’t be allowed to see her dad anymore. After these interviews were completed, the Detective called Mr. S to speak to him about this. He denied all allegations, and it was at that point he secured the services of DM Cantor. 

Once we were retained, we obtained all of the Police Reports regarding Mr. S, and regarding his brother. In addition, we pulled information regarding allegations made to the Arizona Department of Child Safety. Ultimately, we were able to show that the daughter, who was eleven, and was being problematic and acting out. No Charges were brought against Mr. S’s brother for Sexual Misconduct with a Minor. In addition, No Charges were brought against Mr. S for Failing to Report the Abuse as a “Mandatory Reporter”. If Mr. S had been Charged and Convicted of these crimes, he could have easily spent time in Prison. Instead, he has No Criminal History and has a Clean Record.
