State v. Mr. S (DMC No. 16042) – (1 Count) Felony Kidnapping (Dangerous Crimes Against Children), (4 Counts) Felony Sexual Conduct with a Minor (DCAC), and (1 Count) Felony Sexual Abuse (DCAC) – Reduced to Attempt and Probation (with 30 Days in Jail) – Maricopa County Superior Court (Case No. CR2018-006503)  

The first alleged Victim in this case lived in Indiana and was in ninth grade, and started undergoing Therapy. She stated five years prior, she was Molested by her grandfather while she was visiting Arizona. After this came to light, the Indiana Department of Child Safety got involved. The Investigator from Indiana contacted Mr. S, and he admitted that he touched his granddaughter one time inappropriately while she was in Arizona. Ultimately, the authorities in Arizona were contacted.

A Detective then contacted Mr. S’s daughter, who was currently in Jail and was about to be Sentenced for 5 Years in Prison for a Probation Violation due to numerous Charges. She also stated that she was Molested 20 years prior, but was vague on all the details. Eventually, Mr. S was Indicted for 6 Felony Counts, which included 4 Counts of Sexual Conduct with a Minor (Dangerous Crimes Against Children), 1 Count of Kidnapping, and 1 Count of Sexual Abuse. It was at that time he secured the services of DM Cantor. 

From the very beginning of the case, Mr. S denied the vast majority of Charges, but did want to take responsibility for what he had actually done.  We presented numerous items of Mitigation to the Deputy Maricopa County Attorney, which included a lack of criminal history, community support, a good character, and acceptance of responsibility. Because of the proof problem on all remaining counts, the Prosecutor agreed to extend an Offer of Attempt and Probation (with 30 Days in Jail). Mr. S accepted this Plea, successfully completed his Jail time and is in therapy while on Probation. If he would have been Convicted of all 6 Counts originally, he would have had in essence a Life Sentence in Prison.
