State v. Mr. R (DMC No. 18292) – (4 Counts) Felony Sexual Assault, and (1 Count) Felony Sexual Conduct with a Minor (21-year-old Adult/17-year-old Minor) – Not Charged/”Turned Down” by the Pinal County Attorney’s Office – Maricopa Police Department Investigated (DR No. 20XX-XXXXXX5)
Mr. R befriended a neighborhood family when he was in high school who had adopted six children. He would go over and spend lots of time with them, and with the oldest son, as they were good friends. Eventually, they moved to Maricopa, Arizona, and he would go down and visit them in the City of Maricopa.
One of the children they adopted was an African-American girl who was 13 or 14 years old. She was the only child that was Black, and she was from Oklahoma. She would often verbalize that she felt like an outcast, and she was caught acting out in a sexual manner with some of the other kids. Mr. R would go to their household on and off for the course of several years.
When Mr. R turned 21 years of age, the girl in the household was now 17 years of age. Then began to get close, and she would often flirt with him and try to get near him. He went with the family on a trip to California, and he would spend lots of time with both the family and the girl. He eventually started a new relationship and had a girlfriend, and stopped coming around the family.
At some point, the girl began getting into trouble, and she told the counselor that she was “raped” by Mr. R. A Detective was immediately contacted, and came by and spoke with the family. The family’s father had told the Detective that the girl had made lots of allegations against lots of people in the past. However, the Detective still reached out to Mr. R, and that’s when he secured the services of DM Cantor.
We immediately sought out all Police Reports which contained the alleged Victim’s name. We found one report in which she called the Police because she claimed she was walking through the park and a guy tried to touch or kiss her. We found another report in which there was a 25-year-old she was buying pot from, and then she made allegations against him, and he turned out to be a Registered Sex Offender. Lastly, we found one other report in which she was arrested for Assault, but was claiming self defense.
We then made a phone call to the Detective and notified him that we were representing Mr. R. We also laid out all of the issues regarding the alleged Victim, and her propensity for being untruthful. He had forwarded the reports over for Charging to the Pinal County Attorney’s Office, and then we made contact with the Deputy County Attorney, and relayed all of the issues that the alleged Victim had. Ultimately, a decision was to “Turn Down” the charges against Mr. R. Had Mr. R been Charged and Convicted with the five Counts, and given the Maximum, he would have spent over 75 Years in Prison.
