State v. Mr. R (DMC No. 17851) – Felony Sexual Conduct with a Minor (Dangerous Crimes Against Children), Felony Child Molestation (DCAC), and Felony Furnishing Harmful or Obscene Materials to a Minor – Not Charged – Maricopa County Sheriff’s Office Investigated (IR No. 2XXXXXX3) 

The Arizona Department of Child Safety (DCS) received an anonymous call that a high school student at Verrado High School had been sexually molested by her stepfather who had performed oral sex on her. The incident was supposedly to have occurred three years prior (when she was in grade school), after a game of tag, and after she left the shower. The alleged victim also stated that Mr. R would make the victim watch porn with him while he masturbated, and that Mr. R was a former Police Officer.

When DCS arrived at the high school, the alleged victim would not talk with them without her mother present. When they got to her house, the mother stated that the alleged victim had lost her dog and her biological father recently, and was “mentally going up and down” because she was now menstruating, and she had other mental issues. The mother also told the Investigator that she was not married to Mr. R (only engaged), and that she did not believe her daughter’s allegations. The alleged victim then denied that any of this had occurred while she was talking to the Investigator. At that point, her grandmother arrived on scene and claimed that her granddaughter rode with her in the car and stated that she was being molested by her mom’s boyfriend, and that the night before her mom and the boyfriend grilled her and told her that he would go to Prison, and not tell the truth about what was occurring. She also claimed that the incident had occurred two years prior, after her mom had been caught cheating on Mr. R, and Mr. R did it to get even with her mom. 

The alleged victim was taken down for a Forensic Interview at Child Help, and she stated “I don’t know what you’re talking about” and “somebody reported that my stepdad did something, I don’t know because all of the information they gave was false”. She also denied ever telling her grandmother anything, and didn’t know why her grandmother made up the charges. 

DM Cantor was then hired and became involved in the case. We provided the Detectives with the Polygraph of our Client, in which he was “truthful” in denying all of the allegations. We also presented other documentation that showed that this young lady was making these allegations had mental health issues. Lastly, due to the fact that she kept vacillating on her stories to various different people, the Detectives agreed that No Charges will be brought, and DCS closed the case as “Unfounded”. Had Mr. R been charged and convicted, he would have spent the rest of his Life in Prison.
