State v. Mr. O (DMC No. 17835) – Felony Child Molestation (6-year-old Minor/19-year-old Adult) Dangerous Crimes Against Children, and Felony Sexual Conduct with a Minor (DCAC) – Not Charged – Mesa Police Department Investigated (DR No. 20XX-XXXXXXXX9)

Mr. O was married to the alleged Victim’s older sister, and knew the alleged Victim since she was 5 years old. When the girl turned 13 years old, she began regularly drinking, and she felt that her parents were far too strict. She ultimately moved out of her parents’ house when she was 18 years old, and Mr. O and his wife would help financially if she needed anything. Shortly after she moved out, she began dating a controlling older individual who was known to drink and use drugs. The girl worked as a freelance makeup artist, and she began drinking and using drugs. She was ultimately hospitalized several times, and was put on some serious medications due to a tumor on her knee. Because she was mixing recreational drugs with prescription drugs, she began to hallucinate. At some point during a “Confrontation Call” (which was being recorded by a Detective), she accused Mr. O of Molesting her when she was a young child and having sex with her. It was at that time, Mr. O secured the services of DM Cantor. 

We immediately became involved and began interviewing all the people who knew the alleged Victim. We also found out that while she was hallucinating in the hospital, she accused the doctor of trying to steal her organs. She also stated that people were “out to get her” and she made other outrageous allegations. In was at this time that she began accusing Mr. O of past deeds. 

During our investigation, we also found out that the alleged Victim and her boyfriend, who both held Green Cards, were afraid that they were going to be expelled out of the country under the DACA program. It was also discovered that they found out if she could claim she was a Victim of a crime, this would keep her from being Deported. This was the motive for her to lie. 

We ultimately contacted the Detective and provided all of this information. We also put together a “Trebus/Bashir” Letter detailing all of the information we had received, and we insisted that Mr. O be given an opportunity to speak to a Grand Jury, if the case were forwarded for charging with the Maricopa County Attorney’s Office. Ultimately, the Detective made the decision to “Close” the Case and Not Route it for Charges. Had Mr. O been Charged and Convicted of these allegations, he could have spent the Rest of his Life in Prison. Instead, he has No Criminal Charges, and his Record is Clean.
