DISMISSED | AGGRAVATED ASSAULT with a KNIFE (dangerous) DISMISSED – State v. Mr. M. (DMC No. 5764) (Maricopa County Superior Court CR2005-117150): Mr. M. was accused of getting in a fight at Uncle Bear’s Bar in Gilbert, Arizona. He was alleged of pulling a knife on the other person, although nobody was harmed. He was charged with aggravated assault, “dangerous” and was facing 5 to 15 years in prison. A particular witness failed to show up at deposition, and we filed a Motion to Preclude. At Evidentiary Hearing, the Judge granted our Motion and the State was forced dismiss all charges.
