State v. Mr. M (DMC No. 17596) – (3 Counts) Sexual Conduct with a Minor (11-year-old Minor/41-year-old Adult) Dangerous Crimes Against Children – Not Charged/”Turned Down” by the Maricopa County Attorney’s Office – Tempe Police Department Investigated(DR No. TE20XX-XXXX1) and Department of Child Safety Investigated (Intake No. IN01XXXXXO)
Mr. M had been in a five-year relationship with his girlfriend. His girlfriend’s daughters had moved away from their biological father in Virginia and began living with them when they were 8 years old. Approximately three years after they moved in, Mr. M and his girlfriend were beginning to have loud arguments and their relationship was coming to an end. In addition, the mom was a strict disciplinarian, and both kids had ADHD.
On the next day after one of their loud arguments, one of the children went to school and stated that her mother’s boyfriend had been Molesting her. She was taken to Childhelp Center and interviewed by a Forensic Interviewer with the Tempe Police Department present. She claimed that her mother’s boyfriend had her perform oral sex on him, and that he digitally penetrated her and had sex with her. After the interview, a “Confrontation Call” was conducted, in which it was recorded in order to try and secure admissions by Mr. M. He denied all allegations. Detectives then confronted him, and wanted him to come down to the station. It was at that time he secured the services of DM Cantor.
After the girls were removed and put into the Department of Child Safety’s care, we interviewed the mother. She signed two Affidavits stating that she had never seen Mr. M commit any touching or make any inappropriate comments towards the girls. In addition, we had Mr. M take a polygraph test, in which he “passed”. Lastly, after contacting the Detective, we informed him that the girls were now making contact with their mother, and others stating that they had made up the allegations, because they did not want Mr. M to be living with them anymore. Ultimately, the case was “Turned Down” by the Maricopa County Attorney’s Office. If Mr. M were to have been Charged and Convicted of these crimes, he could have spent the Rest of his Life in Prison. Instead, he has No Criminal Record.
