State v. Mr. M (DMC No. 17389) – Felony Sexual Assault (“Me Too” Allegation) – Not Charged – Phoenix Police Department Investigated (DR No. 20XX-XXXXXXX9)
Mr. M and his wife were having on and off marital problems. He got back from Florida and was picked up at the airport by Ms. M. Ms. M claims that he repeatedly kept requesting her for sex, and then eventually she “gave in” and told him to “make it quick”. Several days later, she claimed that he had harmed her during sex, and used the phrase “Me Too”. She ended up driving to Dewey, Arizona to stay with friends.
While she was up there, numerous friends started calling Mr. M telling him that his wife was claiming she was “beaten up and Raped”. They also said that she had overdosed and had gone to a local hospital. Ms. M had a history of mental health issues, and a history of making wild accusations. It was at this point that Mr. M contacted DM Cantor.
Once we became involved, we contacted the Phoenix Police Detective handling the case, and told him that Mr. M had done nothing wrong. The Detective interviewed Ms. M and asked her why she had waited three days to report the so-called “Rape”. Another Supervisor followed up with her several days later, and then she said they would both be going through counseling and possibly getting a Divorce, and that she no longer wanted to prosecute Mr. M. We were able to “Shutdown” the entire case without it being routed to the Maricopa County Attorney’s Office for charges. Mr. M has No Criminal History on his record. If he would have been charged and convicted, he could have spent over 15 years in Prison.
