State v. Mr. M (DMC No. 17203) – Felony Kidnapping, (5 Counts) Felony Sexual Assault (with 5 Separate Alleged Victims), and (2 Counts) Felony Attempt to Commit Sexual Assault – Reduced to Sexual Abuse and Probation (with Zero Days in Jail) – Maricopa County Superior Court (Case No. CR20XX-XXXXX2)
Mr. M was a former NFL football player, who would frequent bars in Old Town Scottsdale. He would often meet women in the bars, and they would go to his place, or their place, and have consensual sexual relations. During one of these encounters, a woman claimed that she was forced to have sex and that it was non-consensual. During the course of their investigation, they also added 3 other women as alleged victims (totaling 4), and then charged Mr. M with Felony Sexual Assault. It was at that time he secured the services of DM Cantor.
As we were defending the case, they also found a 5th alleged victim, and agreed that they would wrap in any Sexual Assault Charges into a Plea Agreement which would result in global resolution. As we started picking apart the State’s case, some of the victims no longer wanted to cooperate. In addition, it was highly questionable about whether they were being coerced by the Police Department to say that their involvement was not consensual. Ultimately, the prosecutor saw the multiple problems they had with their case, and prior going to Jury Trial, they offered a Plea Agreement to a simple Sexual Abuse with Probation and No Days in Jail. Had Mr. M been convicted of just the 5 counts of Sexual Assault, he would have spent anywhere from 5 to 75 Years in Prison.
