State v. Mr. M (DMC No. 16889)

State v. Mr. M (DMC No. 16889) – Felony Child Sex Trafficking (Dangerous Crimes Against Children), Felony Attempted Sexual Contact with a Minor (DCAC), and Felony Attempted Money Laundering – Reduced to Attempted Luring of a Minor (Non-DCAC) and Probation (with Zero Actual Days in Jail) – Maricopa County Superior Court (Case No. CR2020-001271)

Mr. M was a 67-year-old man who was very naïve and gullible, and who was frequently on the website Locanto.com. He was looking on websites to have a sexual relationship with other adult people. An ad was posted by an Undercover Detective that stated “anyone interested in trying some daddy daughter fun”. Mr. M was curious, and he began having a conversation with this Undercover Detective.

The two Undercover Detectives posed as a older couple, that Mr. M thought were interested in having a threesome. In the conversations, they started discussing having sex with their daughter, and Mr. M “played along”. He was eventually encouraged to bring gift cards, if they were going to meet up. During this entire time, Mr. M. thought he was “role playing”, but then began to wonder if these people were serious. He arranged to meet with them just to “see what was going on”. When they met, he was immediately Arrested and Charged with Felony Child Sex Trafficking, Felony Attempted Sexual Conduct with a Minor, and Attempted Money Laundering. It was at this time that he secured the services of DM Cantor.

After receiving all of the Police Reports, we had Mr. M take a Psychosexual Risk Evaluation, which showed that he was “not a risk to reoffend,” and he had never had hands-on contact with a child (as verified by “passed” Polygraph Examination). We also secured records from his relatives that showed that he had been online numerous time, and had been defrauded of his entire life savings. This would include sending money to people who were posing as celebrities, or royalty of various foreign countries. In other words, he had mental deficiencies. We ultimately took all of this evidence to the Maricopa County Attorney, and they agreed to Reduce his Charges to an Attempted Luring (Non-Dangerous Crimes Against Children) with Probation and Zero Days in Jail. Had he been Convicted of the original Charges, he could have spent the Rest of His Life in Prison.
