UNLAWFUL DISCHARGE of a FIREARM (Shannon’s Law) REDUCED to Class 6 Open/Misdemeanor with PROBATION and ZERO DAYS in JAIL – State v. Mr. L (DMC No. 9606) (Maricopa County Superior Court CR2010-122749): Mr. L was at a friend’s house near 25th street and Boston in Mesa, Arizona. Officers responded to a call regarding shots being fired. They saw Mr. L’s vehicle leaving the scene, and they pulled him and his friend over. They did not read Miranda Rights to either of the passengers, and one passenger stated that Mr. L had fired a gun.

Due to the issue with No Reasonable Suspicion to Stop the vehicle (there was no description on the radio call), lack of Miranda Rights and a potentially Illegal “pat down” Search, we were able to convince the Prosecutor to offer a class 6 open/misdemeanor with Probation and no jail. When Mr. L successfully completed probation, the charge was reduced to a Misdemeanor. He had no felony conviction on his record.
