State v. Mr. L (DMC No. 16725A) – Felony Sexual Assault (“Me Too” Allegation) – Not Charged – Mesa Police Department Investigated (ME No. 20XX-XXXX0)

Mr. L had a rocky relationship with his ex-girlfriend, and they engaged in consensual sex in the past. She called him up, and asked him to come over to hang out with her. She was on multiple medications for her anxiety, (which included Zoloft, Buspirone, Latuda, and Clonazapal). She stated she “woke up,” and Mr. L was on top her having sex. She waited three weeks before she reported this alleged Assault to the Police.

She turned over text messages where Mr. L was continually texting her, and he appeared to be frustrated that she was not responding. She was also interviewed at the Mesa Advocacy Center, and no physical evidence was obtained. They then conducted a “Confrontation Call,” where they called Mr. L and recorded it. He stated that he did not remember her shaking her head “no”, and that he thought she was “into it”. 

Mr. L also met with the Police, and provided an interview. He did acknowledge that they had broken up in October, but she was constantly calling him to have him come over during the month of November. He also stated that she was kissing him, and that all sex was consensual. He did acknowledge that the next morning she was not speaking with him, and then he left.

Mr. L then secured the services of DM Cantor after he was served with an Order of Protection. We conducted the Order of Protection Hearing, and the alleged victim made several statements that there was not a sexual assault involved. We also had Mr. L take a Polygraph test, in which he “passed”. We provided all evidence to the Detective and the Maricopa County Attorney’s Office in the form of a Trebus Bashir Letter. Ultimately, No Criminal Charges were brought against Mr. L, and he has No Criminal History.
