State v. Mr. L (DMC No. 15600) – Felony Sexual Abuse (38-Year-Old Adult/17-Year-Old Minor) – Not Charged – Avondale Police Department Investigated (DR No. 20XX-XXXX4)
Mr. L was a Licensed Clinical Social Worker who was counseling a troubled 17-year-old female. At some point, the female told her LDS Bishop that Mr. L had grabbed her bottom while he was hugging her, and offered her money for nude photos. She also claimed that Mr. L had sent inappropriate messages to her iPod. She was ultimately Forensically Interviewed by the Avondale Police Department, in which she also provided them her iPod.
In the meantime, Mr. L was confronted by her Mother about the allegations. He denied all allegations, and then secured the services of DM Cantor. We immediately sent over a notarized “Invocation of his Right to Remain Silent”, to the Detective. We also sent over a “Trebus” Letter which included a “passed” Polygraph Examination. Other information included was the fact that the girl he had been Counseling had been treated for Bipolar Disorder, had been diagnosed with a Psychosis, and was considered to be Seriously Mentally Ill. Some of the symptomology included hearing voices.
The Detective asked if the girl would be willing to do a recorded “Confrontation Call” to Mr. L, and she declined. Ultimately, the Detective made the determination to Not Route the file for Charges to the Maricopa County Attorney’s Office. If Mr. L had been Charged and Convicted, he could have been sent to Prison. Instead, he has No Criminal Record.
