State v. Mr. L (DMC No. 15262) – Felony Fraudulent Schemes ($77,458) with a Prior Federal Conviction for Felony Tax Evasion, and Felony Aggravated Identity Theft – Not Charged/ “Turned Down” (by the Maricopa County Attorney’s Office) – Mesa Police Department Investigated (DR No. 20XX-XXXXXX0)

Mr. L owned a telemarketing company that renewed magazine subscriptions. Because he had a Prior Felony Conviction for Tax Evasion, a Tax Lien would be put on any bank account that he owned. In order to run the business the accounts were put in a different person’s name. He also owned a second LLC that was struggling, and needed cash. He wrote checks from one bank account (from Comerica) into the other LLC. Checks were then written from that LLC, which were on a US Bank checking account. Comerica put a freeze on all of the original checks, which caused all of the US Bank checks to bounce. Those checks totaled $77,458. US Bank had their Investigator work the case, and he contacted the Mesa Police Department who then filed a Police Report seeking Charges against Mr. L. It was at that time he secured the services of DM Cantor.

We were able to show that this all occurred due to Comerica putting holds on checks without Mr. L’s knowledge. In other words, there was No Criminal Intent involved. We then indicated this was actually a Civil Matter, and we coordinated Mr. L and a Civil Attorney to handle any potential litigation with US Bank. Ultimately, they resolved the situation, and when we reached out the Deputy Maricopa County Attorney, they agreed to “Turn Down” Criminal Charges. Had Mr. L been Charged with this Crime, given that he had a Prior Felony Conviction that involved a financial crime, he could have spent many Years in Prison. Instead, there are No Charges ever brought on the US Bank issue.
