State v. Mr. K (DMC No. 14879) – Felony Sexual Abuse (43-Year-Old Adult/12-Year-Old Minor) Dangerous Crimes Against Children, and Felony Child Abuse (DCAC) – Not Charged/”Case Closed” (Due to Alleged Victim Admitting she was Lying) – Phoenix Police Department Investigated (DR No. 20XX-XXXXXXX6)
Mr. K’s wife was a hardcore alcoholic with an extensive criminal history. She would come in and out of the children’s lives, and Mr. K had a new wife and a new life. During one of Ex-Wife’s visits, she called the Police and told them there was no specific reason she called, she just “didn’t feel right” about her husband, and felt he was abusing the kids. She then stated that her one daughter had said that he had choked her with a phone cord, and grabbed her breast. This daughter was 12 years of age.
Mr. K found out about the allegations, and he immediately contacted DM Cantor and secured our services. We immediately pulled all of the prior medical history regarding the Ex-Wife, which included her entering and exiting rehab on numerous occasions, and her prior criminal history. In addition, we secured all of the Police Reports involved in the case. We also had Mr. K sign an Invocation of Rights to Remain Silent, we contacted the Detective letting them know that none of the allegations were true, and that Mr. K would be giving no further statements.
Once we received the Police Report, we saw that during the girl’s interview that the Officer had already received our information, and began questioning the girl. He put in his report that “the whole story was a little weird and it sounded like she had been arguing with her dad and she wanted to stay with her mom”. He eventually asked if she was telling the truth, and she replied “no”. He then spoke with the Mother, and put in his report “I also advised her that I didn’t want to upset her but she needed to talk with her (daughter) about “fabricating a story to get what she wanted”. Ultimately, the case was “Closed”, and the girl was determined “to Not be Truthful”. Had Mr. K been charged and convicted, he could have spent well over 5 Years in Prison.
