Mr. J was a high profile football player for Northern Arizona University. He and some fellow teammates went over to a party one night at the “volleyball girl’s house”.  While he was there, he and everyone involved had been drinking. Although Mr. J had recently started courting a potential girlfriend, he was not exclusive yet. While at the house, another football player’s girlfriend began flirting with him, and was explaining that her boyfriend never listened to her, and that he was not attentive. Although she had been drinking, she was not drunk. Later, she invited Mr. J and his friend to come hang out in her room. Eventually, she asked the friend to leave, and asked Mr. J to stay behind so they could “have a private talk”. She then instigated consensual sex with Mr. J, and shortly thereafter, Mr. J’s friends became banging on the door stating that the girl’s boyfriend was coming back to the house. 

Mr. J then left, and the girl’s boyfriend was clearly upset. People on both the football team and volleyball team began text strings that did not portray the girl in a very kind light. She then talked to her mother, and her mother told her that she was “drunk, not able to consent, and had been Raped”.  This was then reported to the Police and to NAU’s Athletic Department (who then instituted a Title 9 proceeding against Mr. J). 

We became involved in the case, and interviewed all parties involved. We also secured multiple texts, from the girl, and her friends. It was obvious that it was a consensual sexual encounter, and she was merely upset and trying to keep her relationship with boyfriend intact. Not only did the Police “Turn Down” potential criminal charges (which could have landed Mr. J in Prison for over 15 years), but NAU’s Equity and Access Office “Unsubstantiated” the Title 9 Complaint.
