PROBATION VIOLATION DISMISSED/DISORDERLY CONDUCT – State v. Mr. H. (DMC No. 5888) (Maricopa County Superior Court CR2003-027468): Mr. H. was convicted for disorderly conduct and was placed on probation. The probation office alleged that he violated his probation by contacting his wife. We were able to show the court that Mr. H. had contacted his wife to tell her that he was going into surgery. She wanted to be there for him, and she informed the P.O. that she would be attending the surgery. The P.O. then filed the Petition to Revoke. We showed the Judge that they had been married for 25 years, and that the Petition should be dismissed. It was.
