State v. Mr. H (DMC No. 17491) – Felony Child Molestation (43-year-old alleged Molest of a 15-year-old), Felony Sexual Abuse, and Felony Public Sexual Indecency to a Minor – Not Charged/”Inactive Status” – Gilbert Police Department Investigated (DR No. 20XX-XXXXXXXX6) and Department of Child Safety (DR No. 2XXXX5)
Mr. and Mrs. H adopted a young girl who had many problems. She had been Sexually Abused by her biological father, who also had Child Pornography on his computer. Her mother was a drug addict and was diagnosed with schizophrenia and chronic paranoia. When the alleged victim was removed from her biological parents’ home, she was diagnosed with PTSD, Adjustment Disorder and Mixed Emotional Features. In foster care, she was also hurting that family’s dog, and she was transported to the Phoenix Crisis Nursery and transitioned into an Adoption Program. During the pre-adoptive process, she was discovered to have behaviors that included daily self-stimulation in which she would insert objects into her vagina and rectum.
After she was adopted by Mr. and Mrs. H, they discovered that she had been removed from a foster home for killing a small animal by squeezing it too hard. She’d also been rough with her foster family’s dog, and she was found to be “without any understanding or empathy”.
This incident arose when the alleged victim made claims to Mrs. H that Mr. H had come into her room, had fondled her vagina and was masturbating. She was 15 years old at the time she was making these allegations. Later that day, when she saw her Therapist, the Therapist reported these claims to the Department of Child Safety. The Therapist did so even though she thought that this may have been a bad dream that was triggered by her earlier childhood trauma. It was at this point that Mr. H secured the services of DM Cantor.
Once we became involved, we pulled all of the alleged victim’s medical records. In addition, because of suicidal ideation, the alleged victim had been moved into the St. Luke’s Children’s Behavioral Facility. When Detectives showed up at St. Luke’s to interview her, she now changed her story from a 5-minute incident, and now claimed this went on for well over an hour. Mrs. H told the Officers that Mr. H had not been alone with her for more than two minutes when he went to tuck her into bed. Lastly, the alleged victim said she told a stranger online about what had occurred (who she met from a gaming platform).
We had Mrs. H check the alleged victim’s cellphone and she found hundreds of texts back and forth to somebody named “Angel”. It turned out that this person was actually a 65-year-old man from Texas who had been trading sexually explicit photos and grooming the alleged victim. After we had Mr. H take and “pass” a Polygraph, we provided a Trebus-Bashir letter to the Detective with all of our findings. Ultimately, the DCS investigation was shutdown, and the Gilbert Police Detectives put the case on “Inactive” status. Had Mr. H been charged and convicted of these crimes, he could have spent the rest of his Life in Prison.
